oh man, did i get reamed by their return policy. bought a supposedly new espresso machine in a banged up box. at least i was told that it was new... come home only to find out that parts are missing, manual's been written on AND the machine is defective.

so, with a previously sold and defective espresso machine incapable of making esspresso, i go back to the store 2 days later to return the machine. "I want to return this. It's defective and it's missing parts". Fat & ugly lady at counter: "No."

uhhhh.... no? they can't exchange it because they have none in stock and they want ME to go through the manufacturer to get it fixed??? what??!!! on a newly bought espresso machine??!!! lady tells me that since she gave a discount of 20% (she offered to take 20% off if i purchased it that day), it can no loger be returned.... and points to this really really small sign on the counter.... all the way on the bottom somewhere - no returns on sale items... WHAT!!!!!!!!!! ajgjasdo;gjo;awerijgiorja!~~! because i took that discount you offered on a non-sale item it no longer is eligible for return?!!! of course the receipt says 10 day return policy really big... and then on the bottom says see additional return policy at front counter... what a crock of feces!

now the only option they've given me is to contact the manufacturer and return the merchandise to them for repair.... and they'll probably charge me for shipping too.....

hope the cc (visa) can live up to their name. called their support last night and they advised me to work with the manufacturer... which pissed me off even more. citibank was so much easier on disputes. bleh, time to sign that affidavit.

ugh.. my ass is still sore....

So you mean to tell me that you didn't open up an obviously "abused" product at the counter before purchasing it? Shame on you.

File a dispute. I paid for espresso maker, including all parts. I did not receive said espresso maker, including all parts. Store failed to live up to their side of the bargain, thus reverse the charge.

Same argument for store. I paid 20% for espresso maker, including all parts. I would understand the "no returns" if I had received and now wanted to return said espresso maker, including all parts. However, you did not hold up your part of the bargain and failed to give me what I paid for. Thus, this is not a return, but a recognition that you failed during the original transaction.

yeah, that's what i was gonna argue on. plus, the item wasn't really a sale item, rather a discount on the spot. not sure if i should even include that though.

any other points that i should add other than the below:

1. Products not as advertised
-Not new (as in sold previously with obvious marks, contrary to what was stated)
-not all parts received for what was paid
-Defective
2. Retail store not willing to work for an equitable solution
-i.e. no store credit, no exchange, nothing..
3. Only solution would result in additional expenses for me
-shipping costs to manufacturer and time it would take for the repair on an unused product

Along the lines of Dirigible's post contact your State Attorney General's office and tell them the situation, because this comes pretty close to fraud. Also contact the store manager/owner and explain the situation and infer that what was committed was fraud and your intentions to contact the Attorney General's office.
