Scott Peterson charged with double homocide?

I find it ridiculous that in California Scott Peterson can be charged with the death of his unborn child while a doctor and mother are totally innocent and within the law when they have a partial birth abortion done. Doesn't this sound a little ironic?

I beleive that he should be tried on one count.

It's not like if he found guilty they give him two injections
 
I guess it depends on whether you are into the letter of the law or the spirit of the law. And I have no answers for you.

Well however many counts doesn't matter when seeking the death penalty, I think 2 counts may be easier to get a death penalty conviction though. The fact that he can be charged with the death of an unborn child while a mother getting an abortion, which is planned and pre-meditated, is what I find outrageous.
