I'm not a lawyer, but I don't believe you get charged with murder unless you actually intend to kill a person. Though it's egregious neglect, I believe this falls under vehicular manslaughter if that were to happen.
Either way, throw them in and throw away the key.

Seriously, if causing an accident while driving under the influence was attempted murder and causing a death while driving under the influence was murder, I think drunk driving would probably be almost (note: I said "almost") eliminated within one generation.
