scamming a scammer??

so my cousin got scammed online at another forum a couple months back, he got taken for about $375. we tried doing everything possible to get his money back, contacted online fraud sites, the local pd where he lived, etc etc. we had a lot of information on him, but we ended up nowhere. afterwards we found out he had been scamming people for a while, through message boards and on ebay with multiple accounts. my cousin has been following stuff he's been buying and selling under different names, and now we have the chance to scam him (sell him an item he's looking for) and recoup the money he took.

what do you guys think? good idea? or bad idea....we tried everything we could think of to get his money back legit, we even tried working with other people he scammed, but nothing worked.

Bad idea. If all conventional means to get "revenge" and recoup your losses have failed, then chalk it up to bad luck and move on.

Have you considered taking him to small claims court?

my first idea was to say do it. But IDK.

I'd do it, then send him a "package" with a letter that said thatnks for returning my $$. Heh, WTF are they going to do!

well we're not really looking for "revenge" just want to get the money back.

never thought about small claims, does it matter that he lives in michigan and im on the west coast?

If you have definitive proof that this person took your $375 and you got nothing in return, then you are just taking your money back.

The problem is that it may be very difficult to proof it is the same person (it may be a brother, sister, mother, father, etc...) that you are scamming back. You are probably taking a risk.

If you're trying to get revenge on ebay you'll lose. You said you bought on a forum and got scammed. That's easy to get away with. Ebay has more resources to resolve things like this.
If you want to get back at him then sell him something on a forum, but most likely if he's a scammer he'll want the item before he pays.

we defintely have proof that he took the money from us for nothign in return. and we would be selling him something by emailing him, so it would be outside of ebay.

If you got scammed on eBay... prove to eBay that he's scamming people and they'll deal with him, and you just might get your money back if he's been scamming enough for eBay to go through the trouble of taking him to court.

If you do it, then you can not do anything legally to him afterwards. Since you'll be guilty of the same crime. Just something to keep in mind.

had his address, name, even talked to him on a cell phone, had about 10 emails about it too. still couldnt get a damn thing. and he didnt scam my cuz through ebay, it was from another forum. and we're going to be scamming him through e-mail, not ebay.

what legal recourse could he have? i mean he did take money from my cousin, what could he possibly do?
