Worst part is he's going to get away with a few grand before ebay shuts him down, and Paypal is worthless for getting your money back.

"This auction is for a 1 in 5 chance of winning a box containing the above listed prize. The other four boxes contain a gift of money... You are BIDDING on a box and a box ONLY!What is inside is a gift from me to you. Nothing More and Nothing Less! YOU ARE BIDDING ON A BOX ONLY - THAT IS ALL! Remember, whatever is inside your box is strictly
a GIFT from me to you..."

This is one area where ebay could absolutely do better. If the auction is basically a raffle, and if by some chance that's even legal by ebay rules (doubtful, even though the seller claims it is), then it has no business being listed in Video Games - Systems.

it IS legal, but not in that category. I don't think ti's legal with the way he's writing it either (aka not in the title)

This Auction is in NO WAY Illegal or Immoral.
It's always nice to have that as a selling point.

Motels should try something similar:
"We will in NO WAY come into your room at night and murder you as you sleep peacefully, and we would NEVER think of putting your disrobed body in humorously suggestive poses and sending pictures of it to FOX."

An occasional user that creates a bad trade is one thing... but someone who is scamming a lot of people in a short amount of time will come out ahead. Once the money is out of the account.. what can paypal do? Email the one filing the complaint saying the complaint was valid but you can only get back 50 cents.
