Scammed on Ebay *UPDATED*

I bought something on ebay. Specifically This., from lcwskateahy1. I sent the payment and it transferred from my checking account. Well, to make a long story short. I never recieved the item, it has been about a month. I filed a case with squaretrade, he closed it stating "The Item Was Sent." I also filed with paypals fraud services and awaiting a response. 3 other people have had this happen to them. Can anyone pay him a little visit at JNJ Boards & Games, or possibly call him up and see what the hell is going on. PM me if you're daring to take the risk

Oh yeah, aside from that. He charged me 12$ for shipping, which is insanely high, so I pushed a litte to make it 11, therefore making the total $60

I got an update. The seller sent me an email stating:

Dear ziki88,

I apoligize profusly for the delay. Due to circumstances beyond my control, my computer crashed and I had no acesss to the internet. I have your package ready to ship unless you would rather have a refund. If you want the shoes, I will ship out UPS Tues the 1st of June. If you want a refund, I will send you a postal money order for the total you paid.

Yeah so i sent him an email stating I want him to refund thru paypal since that is what i used to pay him. Then i sent another a day later stating:

Dear LCWskateahy1,

please conform to my request or I will have to press charges against you

And my #1 rule for buying anything on ebay, the person has to have a minimum of 10 feedbacks and has to be over 90% good.
