"Scalping" tickets on eBay...

Does eBay crack down on selling concert/sports tickets at higher prices than face value? I've sold tickets before, and there's a disclaimer saying that the auction must be ended as soon as the bid reaches face value.

However, I see tons of people selling tickets for much higher prices (and they aren't ticketing agencies). Does eBay enforce the law, or do they simply put the disclaimers up for legal purposes, but don't actually enforce the rules?


Just curious, because I could have sold some $50 tickets for over $200 I'm sure.

I sold some tickets that I had won from a local radio station. They were for the women's Final Four and they went for more than face value (seriously!).

That was years ago and eBay has never given me crap about it.

just throw in a pencil in the auction, make it look like your selling the pencil with a free ticket to the event. that should be a legal way to scalp

there are jurisdictional laws when it comes to selling tickets online

Scalping is legal in TX, I'd hope Ebay wouldn't bother me.

out of curiosity.. how would this be any different than selling a ps3 or wii? i guess since tickets are limited-time items (only good for X date)?

There are laws against scalping tickets.. but not consoles.

Not in Tennessee there's not. You can scalp tickets in plenty of states.

and if someone complains they remove it.

half the time in NY the ticket sale says it cant exceed like $600 or something, and face value for 2 tickets isnt more than $240.

and NY state law is no more that 10% over face.

Just buy and sell tixx in cali. they dont have laws for this.....there are a few others as well.

This is accurate. I make quite a bit off concert tix for CA.

I don't think they care.

I sold some World Series tickets last year for waaaaaaaay over the face value.
