Good. Some of those patents were pretty stupid. Flat screen. Apple idiots.

Well, "won" is a relative term. It's still on the hook, it's just a question of how much.

At this point, I suspect both sides are really just sticking it out as a matter of pride and legal precedent (i.e. they don't want to give other companies the notion that they'll cave). Tim Cook isn't nearly as sensitive about copying as Steve Jobs was.

Damages not to be calculated on the value of the whole device

Actually that's not quite what the USSC said. Their ruling was that damages can be calculated either based on the whole device or on just parts of the device. The court of appeals had previously ruled that damages could only be calculated based on the whole device.

As such it is perfectly possible that Samsung will end up paying less than the $399 million the court of appeals originally ruled, but it is also possible that they will still have to pay the full amount.
