Collection Agency. They've called over 10 times in the past week. I've told them each time that this was my number, the person they are calling had the number years ago, and that I don't not know or have any contact information for the loser they want.

This is not a case of my number having to be removed from their database. They've been calling for over three weeks (once a day, sometimes twice), and everytime I tell them to remove me and explain the situation. Finally, today, I'd had it. I told them if they called again I was going to sue the company for harassment. The lady told me "we can call you if we want to collect a debt." I told her it isn't my debt or even close to being anyone I know. She said she didn't care and that *I* could pay the debt if I wanted them to stop calling. What the fvck?

What do you guys think? Sick the AG on them? Show up at their office (they are local), and harass them back with a megaphone?

Edit: Just to make it clear, I do NOT know the person they are calling. I know their name (because they've told me), but that is it.

BTW, their number is: (205)290-4214. They are called Nexcheck LLC. If anyone wants to call and waste their time feel free. They are open until 9. I had to engage in retaliation, but these bastards have made me mad.

Update: The calls have continued since my original post. I've received 5 more, and I have the dates and times documented -- as well as a record on my caller ID.

I called them back AGAIN and told them to remove me, and again they promised they would. The FTC replied back that there is nothing they can do unless I file suit against the company in court under the FDCPA act. My State AG has not contacted me. The FCC has not responded either. The last call was last night, but they have not called back since then.

Anymore suggestions? I am really hesitant about wasting time and resources to file suit, but this is beyond ridiculous.

Is your number listed on the Do Not Call list? If so, file a complaint against them stating what you are going through.

My wife and I are in the exact same situation. We have 2 law firms calling about some person that doesn't freaking live here! They keep leaving messages during the day with some long distance numbers telling us to call.

Do you know the number? Add them to a block called list. Call the phone company about it also.

Yes, it is. I filed a complaint the other with them. I haven't heard anything yet.

Record it then contact te state AG and also file a complaint with your phone company as I am sure there are several laws they are breaking.

That only covers solicitors that have no previous connection with you at all. Not law firms trying to collect a debt.

Read through the Fair Debt Collection Act.

http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm

There are rules they have to follow, and things you can do to make them stop calling you if you really want to.

I understand what you are saying, but I don't have a connection to these people. I've no idea who the fvck they are looking for, and I've told them that. If they can't stop calling me then there is going to be trouble. Whether if it through my State AG, FDCPA, or the FTC.

Whatever happened to call blocking?

I think that even if it was your debt, a collector cannot harass you. Check clarkhoward.com to see how to stop it.
I think you may have to send them a certified letter to make it official, but you really shouldn't have to do that since you aren't the one they want anyway.

Yeah, I have to pay extra for call blocking. I already called the phone company about it.

So far I've filed a complaint with the FTC, my State AG, and the DoNotCall FTC complaint database.

The next time they call, speak clearly and calmly into the phone the following words:
"Your debtor's phone number is <insert an ex's phone number here>. I did your detective work for you, since you seem utterly incapable of doing anything other than disturbing me. Now if you ever call this number again, by Sithis, I will eat your first born's still-beating heart on rye bread."

Sorry, you'd better just pay the debt, even if it isn't yours. Unless you like them calling you everyday...

Sounds like one of those bottom feeding companies that buys up old debt looking to collect from someone. Let us know if you get them off your back.

I had the same thing happen several years ago. Someone passing bad checks made up a phone number, and it happened to be mine. The collection agency just couldn't figure it out (they were out of Florida) so I blocked their number. Then the Sheriffs department called, and they figured out the very first time when I told them I did not know who the person was, and I never heard anymore about this mess.

Next time, when you answer, talk in some other language that nobody there would know, like find an English to Klingon translator so that no matter who works there, nobody will be able to figure out what you are saying, maybe they will stop then. If that doesnt work, get an air horn and blow it into the phone.
