It’s generally if the lawsuit is judged to be frivolous or brought in bad faith. From my understanding getting attorneys fees is pretty unlikely.

The experts came to the case with baggage of their own. James Condit Jr., one of the election analysts who signed an affidavit on behalf of Moore’s campaign, has written and spoken about “Zionist” control of world politics, and alleged an Israeli role in the Sept. 11, 2001, terrorist attacks. Richard Charnin, who provided the court with an argument that there was just enough possible fraud to swing the election, claimed to have “mathematically” proven a conspiracy behind the assassination of John F. Kennedy.
The reasons given for this court challenge are nothing short of incredible:

1. There are "rumors" of election fraud, including a viral youtube video.
2. Moore has passed a "polygraph test" about the sexual misconduct allegations.
3. Turnout in dem areas was a couple points higher than usual, and apparently this cannot be.
4. Moore under-performed past republicans by a lot, and apparently this too cannot be.
5. Moore submitted affidavits from two cranks calling themselves "experts" supporting his claim of voter fraud. Here is a description of the "experts":
Moore should be sanctioned (fined) by the court for filing a frivolous court action and wasting the taxpayers' money.
There is a reason Alabama is one of the worst states in the US.The fact that this guy was once (twice!) chief justice of the Alabama Supreme Court is nothing short of mind boggling.

I don't know about everyone else, but this year has disturbingly opened my eyes to the idea that a number of powerful people in the world do not have intact reality testing.
His behavior is definitely a parallel to trump except in Trump's case he won. Is this how Trump will act if he "god willing" does not get re elected?
