RMA my video card?

I bought a refurb 9700 Pro from Crucial, restored to a clean system, uninstalled old card and drivers and put in the card and newest appropriate ATI drivers. System seems fine but locks up running 3dmark2001se. Seems to be a heat issue, was locking up in 3dmark after 5-10 minutes of fill-rate test, but I opened a window and took case cover off and it ran fill-rate for about an hour and a half before locking up. I also tried Max Payne at highest settings, I couldn't see MBM temps but this also eventually locked up more than once.

My cooling was fine for my GF3 ti200 to never have these issues. I have an 80mm fan blowing in from the front, 80mm fan blowing out the back, a side vent opposite the cpu fan, and about 2 inches clearance from the video card to PCI cards. I have about 24 days left to RMA, is there anything else I should try first? I'm not interested in spending a lot of money on advanced cooling that may or may not allow the card to run reliably at stock speed, in my opinion a card that can't do that qualifies as defective.

go ahead and try the RMA.. considering it's definatly the card, there's nothing else to really fix.

P.S. have you actually run any games on the card?
 
I was just wondering if other factors might be in play so I don't RMA and have the same trouble all over again. I ran memtest86 all night w/ no errors. I don't currently have any modern graphic intensive games to test it with. I've tried w/ Max Payne (patched to 1.05), one time it ran for an hour and a half before locking up, but the dream level where everything warps seems to do it every time, I was thinking it might be because it was more fill-rate intensive, more strain on the card? Ran SOF2 last night for an hour w/o trouble. I just don't want it to actually be software issues w/ 3dMark2001 and Max Payne and not the card that is the problem. Thanks.
 
rma it. if it happens again, the card may not be compatible with your system. happened with my video card as well (i actually replaced the mobo instead). 🙁
 
I have similar problems with my ti4600. If you see texture corruption before the lockups then it may be overheating. I guess you already checked the fan. I don't really think your card isn't compatible (but that can not be ruled out). Check the card in another computer and, if it fails again, RMA
