This is on a forum, we agreeed i sell him for a phone for XXX. And this is how it went down, he paid me on the 19th at 1.00pm and i shipped it at 2.20ish the same day. I gave him the tracking number the next day. we never talked about the deal and being a nice guy i gave him free shipping and tracking. this is thru USPS.
then as time goes on he didn't get his package. Now he demands a complete refund and he will send me the package when he gets it. I think this guy is completely bogus and dumb. We never discussed shipping. I told him normally 4-6 days because thats what the postal office told me.

FYi this is the tracking number

0304 1560 0007 2950 6163

www.usps.com

Am i right for declining his refund. he also mention he will report this to whomever. Guys i need help ASAP. I dont really know my rights.

I told him i completed my part as a seller and its not my fault any more and that he can't blame me for what i have no control over. Its USPS who he has beef with. I can only help but i can't fix the problem.

Am i right?

Sounds like this guy's being a tool. You shipped blazingly fast, and you're not responsible for USPS being slow. It's still in transit, and if he's got an issue he can whine at the postal service.

Who is he, so that he can join a load of DNT lists? Link?

He knew the consequences of shipping through USPS. If he wanted it faster he should've paid you to upgrade shipping. It's not like the package is lost. Especially considering what time of the year it is, he should cut you some slack.

Shipping was free. If he wanted it faster he should have stated so and paid for it.

need more info:
what forum?
what kind of heatware does this fellow have?
how much $$ are we talking?

On some forums (like this one), it is the seller's total responsibility to make sure the buyer gets the package.

This seems like a "nightmare", hopefully it will all work out.

even on AT, it would be understood that if the buyer were to agree to take USPS as means of transport you have to wait a reasonable amount of time. 1 to 2 weeks is not unheard of for USPS and during holiday seasons, one would have to assume it would take longer. anything less than waiting 2 weeks under the circumstances would be unreasonable.

well i dont wanna give out any info yet on the person. he is a person on here. 105 is what i got. well i asked for 105 non-cc paypal. he accidently paid with a CC. made up for it. but i got $103 and some change. i dont care about that part.

the thing is its to canada!!!!

he has like 2-4 heatware just like me.

his statement to me after i said no

" w That's pretty bitchmade, but I'll live with it. You'll still receive your positive heat feedback if the phone arrives in working order because like you mentioned you did live up to your part of the agreement.

That right there is where businesses make or break it. Customer service. You just proved that you should never operate one. I for one have done many returns because said customer needs the money back for bills or whatever reason. It's not like I can't resell the phone again.

With that being said why in the world would you ship it Parcel Post? That's gotta be the absolute worst way to ship a package not to mention it's not cost effective and all it seems to do is piss of the receiving party.

Thanks anyways."

If he's in Canada and you're in the US, then he is screwed. It can take sometimes over a month for a package to reach someone in CA due to customs and technicalities. I assume you guys talked abou the details of shipping, etc before the deal was finalized.

You are in the right.

Whenever I sell something I make it crystal clear the method of shipping and offer to option to upgrade (at the buyers expense).

This way they can't bitch and if they do, they will get pwn3d.

I shipped to Canada before. It was a month before he received his package. It seemed that his local post office didn't tell him he had a package and only found out about it when he went there asking.

I don't see anything wrong with Parcel post.

Anyhow, from what I understand, two customs centers (uh.. calgary and winnipeg?) are shut down (temporarily or permanently, i don't know).
So, everything has to go through vancouver and things are backed up something fierce.

The last package i got out of europe should have taken.. say 12 days max. It ended up taking something like 6 weeks, because of the hugeass customs backlog.

I'm a pretty established buyer from Canada. You are in the right, for sure.
I'm with M4H this guy is a tool; you incl. free shipping as well, and you're still doing great communication.

Who is this guy?
If he needed it earlier, he can pay extra for shipping. Plus it's Christmastime. Enough said.

Dang, 10 days so far.

Edit: "Now he demands a complete refund and he will send me the package when he gets it."

Hahah, yeah right, like he'd do that. You'd just be doubly screwed. Stand your ground, it's not in your hands anymore.

tell me about it. i understand the point where is is coming from, being pissed an all. But i offered to cover shipping for $5 with tracking. I didn't say parcel post or proity mail because i didn't know which is cheaper. I didn't want to spend more then 5$ cause then i would be loosing money.
