Resigning my position tomorrow.

Well a job offer that has been in the works has finally come through. So tomorrow I'm going into work, even though I had take this week off with vacation time, to tender my resignation after almost 16 years with the company. Should be interesting to see what the reaction will be. I'm betting our fine young company president will thinking "chaa ching" as the dollar signs flash across his eyes. He'll be happy to save the salary and dump my work on everyone else, that is until he finds out the other guy in the office that will be getting the biggest share of my work is also resigning after the first of the year. That's when the fun really starts. I don't think the CEO (the presidents father) will be very happy at that point.

There's a slight chance he'll be a dick and fire me on the spot, thus screwing me out of about 9K in vacation pay and Profit Sharing contributions, but in order to start the new position when they need me and give enough notice to make a somewhat smooth transition, I need to give my notice tomorrow. So I'll have to chane it.

Should be and interesting few weeks around the old workplace. Wish me luck.

Best of luck Fathomdude, I remember your past thread on the issue. You were loyal for 16 years and if the new president can't see beyong pure $$$ then it's his problem. Congrats on the new position.

good luck dude. this is about the new guy who took over his father's business and he wants to get rid of your postion and hire some idiot to do your job for less money but you were highly valued in his father's eyes as an employee and you've been there since the company first started? a manufacturing plant of some sort? i remember reading your last thread about his but wasn't sure.

Thanks Windogg, the new position will be a good challange. They gave me everything I ask for including going in early so I can be out by 4:00 and beat traffic on the long drive. They don't have anyone else in the company, let alone a manager, that gets out before 5:00 so they were very accomodating.

Good luck to you tomorrow, boy would I love to be a fly on the wall and see the action in your office!

Vacation can't be taken away, it must be paid out if it isn't used. If he trys to fire you AFTER you resign you can get a lawyer and sue him for the vacation money. Vacation is considered money you have already earned in every state I know of.

If you actually fear him trying to fire you to get out of vacation, take a written, signed and notorized letter of resignation in. If not, I would still recomend a signed letter of recognition.

I know that any lawyers who read this will correct me if i'm wrong, but I don't believe termination because you hand in resignation notice is legal. If you're vested, which 16 years i'd say you are, they need a reason to terminate you, such as "poor workmanship" "comes in late" "always drunk on duty" "cursed at the boss" .. something like that... I don't think "tendering a resignation" is a valid reason for temination.
You could sue for wrongful termination, and it would be more costly.

But don't quote me cuz i'm not a lawyer... just someone who'se quit more than his fair share of jobs.

rahvin I guess I should have clarified. I need to work the first "work day" in the new year to get my 4 weeks vacation pay and profit sharing contribution. As long as I work at least one day they have to pay it. If I were to quit or they decide to fire me before then, then I'm screwed. I don't think he'd do that and if he did, one call to to the CEO would rectify that so I'm not too worried.

guyver01 Michigan is a "Right to work" state which means I can resign or be terminated without cause and without notice.

Are you talking about your vacation that you'll earn next year, or what already is earned? Profit sharing from this year, or next year?

The safest thing to do is resign the 1st day of work in 2001. I can't see how it'll make all that much difference, that's only a couple of work days. Two weeks notice is "professional", but I've received less as a manager and understood the reasons.

Vacation that already is earned is probably safe, even is a right-to-work state. I have no idea about the profit sharing. Handing in a letter of resignation may be grounds for termination, again I'm not a labour lawyer in your state, but you are taking a risk.

Fathom, I'd suggest quitting after the new year starts. Why risk what's due to you if you know the boss is a jerk and is only after the green and will do anything to screw you. Play it safe, he'll still get what's coming to him.

Rahvin VACATION is a benefit that can removed at anytime. So yes he could lose it and not have a leg to stand on. :Q

Zorro - Most states will nuke a business that takes away something from an employee that has been earned. You can say - no more vacations in the future. However, you must payout the accrued vacation.

Actually, vacation is a privilege and not federally mandated...also, if your salary or hourly wage equates to 100k/yr and there is a discrepancy on hours/time owed, etc., the employer is only required to pay out minimum wage.

However, CIVIL action can obtain what is rightfully owed.

PUX - Are you a labour law lawyer or do you have a lot of experience in this area? I'm not a lawyer, but I've worked as a manager in several states and worked with lawyers on HR policy surrounding vacation. There is no need for a Federal mandate, most vacation laws are set by the States. Most states are very employee friendly and the laws are designed to ensure that businesses cannot rip the employees off. Not paying earned vacation is a big problem every state I have worked in. It doesn't matter what the salary level is.
