Reported for cheating in EBAY?? HELP!!!!!*Update*

I'm dead pissed and this idiot in Ebay is reporting that I've cheated his money and all. It all began when I had a delay in shipping his Tbird which I pulled out my system to replace it with the 1.4Ghz I have now. I was slow to send the chip to him because I did not know he sent money through paypal. Somehow, paypal did not inform that I have cash.

So I found out a week later that I have money. I received the cash and college started. I was slow to send out the chip. Fine, it's my fault. He filed a complain to the ebay authorities and they emailed me. I replied it explaining what had happened. The person that bought from me has been mailing me and I'be BEEN CONSTANTLY REPLYING IT. He then send me this mail today:

"i cant believe how much of a liar u are im putting a complaint against u with the ebay officers that chip is no good and u new it u just looked to rob someone but guess what i will get my money back u wait and see. by the way u must be some kind of coward not to return any emails"

I don't know WTF is wrong with him. I sent him the chip. I'm not sure what he meant that the chip was not working. I packed it well and everything was sealed from static. It was working before i sent it to him. He nows accused me of burning him. :(

Do I have a case or do I just have to lose all the money. :(

I've alwaysreply all his mails. He keeps going to the authorities before confronting me about any problem. Each time he mails me. He will accuse me of not replying. I've always replied his mails but never get a reply in return. The next mail that I get from him will always be either a warning or accusation.

As everyone knows, I sent him a mail explaining that I've replied all his mails. THis is his reply.

"that's ridiculous because I have all my correspondence with u saved in case I needed it ..... and as far as ur chip I took it to a computer store to have it tested and they told me the dam thing was dead before I even tried to install it so please don't try and turn this on me because it wont work . and this is the first email I have received from u that's why I put the negative report there . please send me ur correct name and address and I will send u back the chip u will receive it certified so u will need to sign for it so I have further insurance as to ur signature for my case with ebay if u don't return my money . im sorry it went this way but I tried to work it out with u and u never responded "

Few things irked me here. He said that the com store verified that the chip is dead even before I sent it to him. HOW can this be verified?? I've been in the computer field long enough to know that you cannot know when the chip is dead. Unless there's a damage on the core, I don't think he can know that it's dead even before I sent it to him. The core is perfectly fine.

I offered to pay him 50 dollars in return and tell him that he MIGHT have killed it and not me. Do you think I'm making the right move? Or should I just wait for him to file a report to ebay??


Update and again. 1/21/2002

This is the email that I got from him and he admitted that he did not receive the last mail from me even though I sent it to both his AOL and Yahoo mail. He checked the AOL mail and it was not there but the Yahoo mail received my latest one. Here is what he has to say.

"i just checked my aol e-mail and that is the problem cause if u sent a message there i never recieved it. and yes i would be interested in that site cause i build computers aolt mostly for college students who dont have alot of money so they want cheap stuff . thats why i usually buy on ebay so thanx in advance

He said that he'll mail the chip back to me but there's now news from him. No nothing. Mailed him once but he did not respond. What's up with him?! :| He dissappeared after knowing that it was his email that was gay when mails are not going in.

even if you asked for it back to verify it's dead, wouldn't take much for him to sabotage the CPU by just running it w/o the HSF. I'd say maybe the best thing to do is give him a refund and go on with your life. I'm sure it wasn't that much money if you swapped it for a 1.4g.

What if HE KILLED IT?? I mean. A chip can be very vulnerable. I sold it as it was working and he might have killed it with his fingers??

Its obviously his spelling and grammar skills tip off what kind of a little kid he is.

Send him emails with return recipts, so you can prove he read them.

thats why I would never buy or sell a cpu on ebay.
I don't like selling AMD cpus at the oem computer store I work at....
we are to the point where we make the customer inspect the processors they get and sign off on their invoice that it is free of damage before we let them leave with it
people come back all the time claiming we sold them the cpu in a damaged state
like a week ago some jerk freakin THREW an athlon 1.4ghz at my manager!
our store can't afford to eat the cost of customer's breaking their cpus...we have really low margins
I think it's really ridiculous how that customer could get so mad at us because he chipped his core... he had even signed the invoice after inspecting it when he bought it.
I feel for you pillage2001 :disgust:

Depends what program youre using. Just use the help function. Save all his emails, and send them to ebay or paypal or whoever asks you. Theyll be on your side. And more than anything else, DONT LIE. One lie, and he wins.

I wouldnt worry about it. One guy did the same thing to me, and I told him the same. He told me he was going to start an investigation, and had the same ridiculous spelling and grammar. He's just a kid, and you wont hear a peep from him again.

Tell him youre not going to give him his money back, period.

Somehow? What happened to the contact with the buyer that says "Pay this amount"? If you don't realize you've got money, another contact that says "Wanted to double-check that you got my previous email, please pay this amount".

The delay will get you into hot water everytime.

Did you do everything you were supposed to? It sounds like you've got a fine case, just gotta make sure the punk can't rip you off. Worst case scenario should be a refund and a return of the original chip.

Keep track of any and all of the emails as well as any receipts for shipping (please say you shipped it with some sort of tracking). Be factual, clear, concise.

At least a few days after he sent the cash. About 4 days. He was a new user. I was afraid that he would file a complain and retract the funds he sent me. I'm just scared of getting rip because I thought he did not send me any cash until a week later.

I did not get any more mails after that. I have mailed them my reasons and explain why I was late.

well, at least he won't be able to cheat you though. at least he won't gain anything from it. i guess it depends on your financial situation, but i'd rather take a loss, prevent something negative showing up on my record, and make sure he doesn't gain anything.

consistantly lazy.

check your e-mail and send it at least 48 hours after you get paid (if possible ie weekend, natural disaster ect) that is your own fault. at least you admit it.

If you offer a no DOA warranty (with a time limit so they just do not say I just installed it!) then they have no recourse unless the chip was tested right away. and If it is DOA you should refund him and wait for the shippers insurance if you bought any yourself.

BTW if he is ignoring you then he is trying to get money out of Ebay probably.

He won't gain anything but I'll lose my chip and the amount I paid for it. :( If this kinda sh|t works in ebay. I'm gonna buy stuffs and report people for selling dead stuffs to me!!!!!!

Anyway, he's a new trader with 0 feedback.

Look. I CHECK MY EMAIL EVERY 3-4 HOURS AND REPLY WHAT EVER MAILS HE SENT ME! He said that I did not reply any. WTF is going on here? I did not offer a DOA warranty. Heck, this is my first time selling! I've always been the buyer for crying out loud!

I sent the money to my account. I waited until the money is in my account. Then I sent him the chip. It took 3-4 days.

So uh... how would you lose your money? The only way that you would have to pay him back is if ebay did something about it. And if you explain your situation to ebay with proof, then they should take care of it
