For victims of 'landlords from hell,' home is where the hurt is


"Think you have the landlord from hell? Think again.

Did they steal your stuff? Lock you out? Threaten you with a gun? Unless they did, they're not even in contention for the title.

Husband and wife, Kip and Nicole Macy, pleaded guilty to felony charges of residential burglary, stalking and attempted grand theft this week, after terrorizing tenants for years, the San Francisco District Attorney's Office said Wednesday.

"The actions of these defendants are so outlandish and brazen that it sounds like the plot line of a horror movie," District Attorney George Gascon said.



'Landlords from hell' behind bars How bad did it get?

Kip and Nicole Macy so badly wanted to evict tenants from their apartment building in the South of Market district starting in 2006, court documents say, that they cut holes in the floor of one victim's living room with a power saw while he was inside his apartment.

"He actually saw the saw coming up and trying to saw through," Assistant District Attorney Kelly Burke told CNN affiliate KTVU.

The Macys also cut out sections of the floor joists.

Before making the cuts, Nicole Macy took the time to consult with a city building inspector to make sure she knew which beam to cut to make the building structurally unsound.

"They want to make it collapse," Ricardo Cartagena, a former property manager for the Macys, told affiliate KGO.

Kip Macy later bought a semiautomatic handgun and threatened to shoot Cartagena after he refused to cut the joists himself. The couple eventually changed the locks to Cartagena's apartment, removed all of his belongings and destroyed them, court records show.



Not done yet

Nicole Macy also created a couple of fraudulent e-mails accounts to stir up trouble.

In one, pretending to be one of the victims, she fired the attorney who was representing the victim in a civil case against the Macys.

From another e-mail account, Macy sent a message to her and her husband's civil attorneys, threatening to kidnap and dismember their children. In the e-mail, she pretended to be one of victims.



Still not done

Over the course of two years, the Macys cut the victims' telephone lines and shut off their electricity, gas and water, court documents say.

Nicole Macy told workers to board up one victim's windows from the outside while he still lived there and falsely reported trespassers in the victim's apartment, causing him and a friend to be held at gunpoint by a police.

They also broke into the units of three tenants, removing nearly all of their belongings. In a separate incident, the Macys soaked their beds, clothes and electronics with ammonia.



Side trip to Italy

After being indicted by a grand jury in early 2009, the couple fled the country. More than three years later, Italian special agents apprehended them in May 2012 and returned them to the United States last month.

They will be formally sentenced in August in a plea deal that will send them to prison for four years and four months.

Cartagena said he was happy to hear that the couple would be going to prison.

"I feel happy," he told KTVU. "Finally there's justice coming."

Yeah, I'd like to hear what the tenants did.

If they refused to pay rent, they deserved it.

It needs to be easier to evict people for non-payment of rent.

Yes but not legal.

Something I read said the rent in the area had exploded but current tenants had rate caps so the LL wanted them out to make more $$.
 
San Fran is rent controlled. I wonder what the tenants did? Not justifying their actions but something must have made them desperate.

They probably didn't want to move out of their rent controlled apartment. So obviously they deserved to have all of their belongings destroyed.

It's possible, that's why I said their behavior is not justified. I'd like to know the rest of the story.
 
I don't think I would want to be a residential landlord. I worked for this guy years ago, ostensibly in a copywriting position, but he had all sorts of little businesses and would ask me to do different things in support of them. One morning he had me accompany him to evict a tenant, probably because I'm a pretty big guy. So I had to stand there while this guy and his wife and kids are tossed out, along with all their stuff. Completely understood the economics of it, but I didn't want to be there, and still don't.
 
I literally laughed out loud while watching that video. The video said the landlords would fill apartments with ammonia so people would move out. I joked about doing that before! I think I even posted on this forum or some other forum that you should poor ammonia under the door of your asshole neighbor. Last week I was waiting for the bus and a lady from my building said there was a time when people were living at the bottom of the stairwell and I said the problem could be solved by pouring a quart of ammonia into the stairwell.

Before reading the post in its entirety, I'm going to side with the landlords. If telling people to get the fuck out doesn't work and the law is not on your side, what else can you do to get meth heads out of your building? You fuck with them. You board their windows, you "smoke em out" with ammonia, you cut off the power or water to their unit. I can't imagine the laws being so bad that I literally do not have the right to get meth head tenants out of my house/condo/building. What ever happened to the castle doctrine? You're in my house under my terms. If I want you to leave and you don't leave, I should have the right to shoot and kill you. End of story.
 
They wanted the tenants to leave so they could sell off the units as condos. Yea the landlords in this case were pretty well off to run off to Italy for 3-4 years before getting caught.

So I'm taking from your post that you're on board with them threatening to shoot the property manager when he wouldn't cut the floor joists, but what about the email they sent pretending to be a tenant threatening to kidnap and dismember their lawyer's children?

Threatening the property manager then firing him was wrong, but they had the right idea. They should do their own dirty work and kill the tenants themselves instead of asking someone else to do it for them.

I think it was on a different forum where there was an issue in the UK with squatters invading the houses of people who went on vacation. The home owners didn't have the legal right to kick the squatters out. People on the internet suggested lots of things such as boarding the windows then padlocking the doors shut, piping car exhaust into the house, setting the house on fire, releasing hungry dogs into the house and various other things that involve killing the squatters.
