Just a reminder, the new Check 21 banking law goes into effect today. I know a lot of you don't use checks anymore, so this is just for those who do.

Banks Implement Check 21 Starting Thursday

NEW YORK - New federal regulations designed to speed up the processing of checks went into effect on Thursday, and consumer advocates advised Americans to be more vigilant about monitoring their accounts.

The Check Clearing for the 21st Century Act ? better known as Check 21 ? will allow financial institutions to exchange electronic images of consumers' checks rather than transporting the actual paper checks around by air, land and sea.

As a result, checks that consumers write are likely to clear faster than before, so there will be less "float" between the time a check is written and when funds are debited from the account.

And consumers who still get their checks back with their statements ? about 36 percent of bank customers ? are likely to begin seeing images of some checks among the paper ones.

The changes won't happen overnight.

Forrester Research of Cambridge, Mass., estimates that it will take until the end of the decade for banks and credit unions to digitally process checks from start to finish. It said that some major banks won't have fully implemented image exchange processes until about 2008.

Still, consumer advocates warn that if check writers aren't careful, they could easily overdraw their accounts and end up paying late fees and other penalties.

Joe Gillen, chief executive of Pinnacle Financial Strategies, a consulting firm in Houston estimates that "consumers could be bouncing almost 7 million more checks and paying an additional $170 million in fees each month."

The U.S. Public Interest Research Group and its state PIRG affiliates recommend that consumers:

_ Only write a check if they know the funds are in the bank.

_ Understand that they need to seek a "substitute check," which is an electronic copy of their paper check, if they get involved in a payment dispute.

_ Carefully monitor their bank statements in case the new electronic system results in a check being double-debited or the amount of the check being misread.

If a mistake is made, Check 21 requires financial institutions to credit an account within 10 days.

Americans currently write some 40 billion checks a year, but the number has been falling steadily as consumers make more use of debit and credit cards as well as online banking.

Hmm, I could write that.

We always keep a $1,000 + buffer in the checking account to prevent this.

But online bill pay freaking pwn's me. 😛 I want my wife to switch to a bank that supports this. Our current bank is a small mom & pop bank that isn't that advanced yet.

they need to find a way of doing electronic payments from person to person, instead of just person to business through credit cards and debit cards.

yes but Paypal is an evil cockaspaniel..

i got a pamphlet from my band detailing Check 21 about a month ago. I've only written one check I think, so doesn't reall affect me.

it's a GOOD thing...it means that the whole "Forge a cashier's check, send it to a poor sap in exchange for something valuable, the guy will ship when it clears and you're done" thing will stop working.

Hopefully, that is. I don't know if this system means checks will clear in less than the seven days it takes for funds to be released.

some one correct me if i'm wrong, but I don't think it has to do with your credit union.

If whoever cashes your check uses this, it will be presented to your credit union faster.

Yup. Even if YOUR bank/CU does NOT participate in electronifying checks, if any banks in the processing line (and there could be several involved) participate, your check will clear your account faster.

DON'T PLAY THE FLOAT.

I write a whopping 1 check a month for rent.

Even though they receive it the 31st or 1st they WAIT until the 8th or so to cash it.

Annoys the Ferengi out of me!

My wife works for Wells Fargo, apparently they are testing something like that right now. Not sure when it could be released.

I got my first credit card/opened my checking account about a year and two months ago. I've written a grand total of 1 check in my life, and I go through about $400-600 in charges every month.
