Ummm...that's why it's insurance dumbass. Nobody expects to get hurt, or plans on being in an car accident, or assumes their house will burn down, but it's why you get insurance, in case something bad happens.

The head of the nail was almost certainly recessed completely, flesh probably closed around it.

Nail guns are designed to drive a nail flush (or even slightly recessed into) wood, it's no match for flesh & bone.
