Regarding the OS X lookalike desktops on XP - are they even legal?

I've seen a lot of people trying to duplicate the look of mac OS X. I've seen a lot of these people have the OS X icons on thier desktop. Now, I'm not certain, but I'd think that if the smilies on this website are copyrighted, the OS X icons probably are too. Now, apple doesn't seem to care as much about thier icons being used as zuni does about his emoticons, but that's really not the point. Are these apple clone desktops violating copyrights?
I'm just curious, no need to flame me if you have an OS X clone desktop.

Apple's gone after some of them, but the really good ones seem to survive. Probably because Apple's happy to get WinXP users "wanting to have a Mac"

Edit - But just imagine what MS would do if someone made a WinXP skin for OSX. :Q

I *can* pluck out my pubes with a rusty monkey wrench, but I sure as hell aren't going to.

That's like someone saying they CAN mod their Ferrari to look like an AMC Gremlin. OSX has a much better UI and isn't as Fisher-Price as XP is out of the box.

Besides, if you're running OSX and you need XP, just fire up Virtual PC. Voila.

You should make one that borrows from OSX, but doesn't copy it. I like the "Brushed Graphite" one, but I never liked any themes that directly copy the mac.
