Refunding stuff on Ebay...Do I get shipping back?? Poll

Ok so I refunded a product on ebay that was misadvertised. The seller does not state any terms on the refund or in the original ebay advertisement regarding refunds. He recently issued me a partial refund minus shipping so my total was about 135 and he gave me back 120 for the refund. So in this case do you think I am right to pursue the extra 15 dollars for shipping since the item is misadvertised and there are no terms for the shipping??

Unless the seller jacked you on shipping you do not deserve to get shipping cost back b/c the service was paid for and used already

What did you buy and how was item mis-represented?

It was a cell phone that was represented as new. However it was an open box item that did not include any accessories or manuals or original packaging. just the item itself. The item also has a noticeable scratch. The advertisement said the item is new and did not say any thing about open box or missing stuff.

Even though he did not jack me that much on shipping, what he advertised was false and he misled me to buying the item. So isn't he liable to refund me shipping also.

Going back your reasoning of the service was paid and used, what happens if he misrepresents and item and ships me a really heavy item that costs 500 bux for shipping. Then I am out 500 bux??

It sounds like he blatantly and intentionally misled you, so I think you're entitled to a refund of your shipping charges.

If the item was significantly different from what was described - and it sounds like it was - you should chase the shipping charge and the cost of you shipping it back.

Dun think I can get the shipping back to him money since its up to him if he wants to refund that part, but with the other shipping charges, I can get paypal to mediate.

Yes, that is the ethical truth, however, I don't think either PayPal or eBay will support that.

File a dispute w/ your credit card company. Apparently paypal is powerless when a charge reversal is filed. Thats how i was cheated out of both product and money from a buyer...

Give the seller two options
a, send you a new phone and you send this one back
b, refund you the full amount + shipping back or you do a charge back.
