**Realtor is handing out my information to everybody

Long story short I put a deposit down on a townhouse. I had 3 days to back out of course if anything happened, it?s a state law I believe. My loan was supposed to come through later that same day but unfortunately I got declined.

Suffice to say I was pretty bummed myself; I had all these plans for my new place; settle down whole future family planning thing. But anyways I called the realtor I was dealing with on the next day, sincerely apologized and asked for my deposit back. She said okay but told me to hang on and said I should talk to her manager for a second.

By the way she was really nice and sincere the whole time she was showing me around, and we went to 6-7 town homes in a 2 week span. Anyways when her manager came on he was super nasty, starting out by ?hey what?s wrong with you don?t you own a calculator or something?? I said ?excuse me, sir? he said ?you wasted 2 weeks of Sandras time and then you just back out? Don?t you know how much that costs?? I went ahead to explain to him that I got declined and I was pretty bummed about it myself.

He began saying I was lying, I was a dishonest person etc etc and at the end when he finished and I wanted to explain that was not the case at all he hung up.

Now this happened late last week, since then SOMEBODY (obviously him) has been submitting my name, cell phone, and house phone number to MANY MANY online money borrowing sites, who are calling me 24/7.

I called the realtors back Tuesday morning and spoke with Sandra and explained what was going on and she said don?t worry Ill take care of it, but once again somebody submitted my information this morning at 9:07am to www.lowermybills.com (I know this because 2 people called and told me that they got my info from a post I made on that previously mentioned site).

What do I do? What can I do? I work pretty much from 7 am to about 7 pm, and don?t have much time to go running around chasing after people. Any quick and simple advice would be MUCH appreciated.
 
did you get your deposit back?

i would contact the local real estate board and speak to someone there, maybe they can help you file a compliant or point you in the right direction.

i would also speak to a lawyer or at least send a certified letter askign him to cease his stupidity
 
yeah contact a lawyer. IF they can prove he is the one doing it hten they are in trouble. first off each time you try for credit and are declined it hurts your credit more.
 
Wow, that sucks. That realtor's broker is WAY out of line. Sometimes it just doesn't work out, even when everyone wants it to. Farming out your personal information to LowerMyBills was VERY unethical. Any halfway decent realtor should already be working with several mortgage loan officers who could have helped you in a private, personal manner to secure financing. That this realtor (and her broker) don't have such an easily available resource really makes me question them.

Demand your deposit (earnest money?) back. If they won't give it back nicely, complain to the BBB and whatever agency in your state regulates realtors.

edit: I would also inform them (although you sound like too nice a guy for this) that you may still consider buying a home, but that they most certainly will not be your realtor, because of their lack of ethics.

They're not submitting credit applications. That would be highly illegal.

They're basically just signing him up for spam.. to lending sites. LOL.. Maybe it's some lame attempt to get you another loan? As if you'd continue to do business with him after the way her manager treated you..

Anyway, it's probably still illegal. Call and talk to him again. Say that if it continues, he will be getting a call from your lawyer. That will probably stop him cold.

Uh yeah. I admit that I have used LowerMyBills as a lead source. It's pretty hit or miss. It's just a lead source though, not credit applications. Basically, it's just name, phone #, address, and basic info on what the prospect wants. You still have to contact the prospect for additional information (particularly SSN#'s) and authorization in order pull credit, etc.

The unethical aspect is that, after he informed them that he wished to cancel the transaction (and for a valid reason, his financing was declined), they are violating his COPPA privacy rights by distributing his nonpublic personal information against his wishes.

edit: it's not illegal though, just unethical. And certainly more than enough grounds to get his deposit back (although having his financing declined was enough reason as well).

Yeah. What a douche.. especially if he actually think he's doing the OP a favor.
 
Uhmm... how do you know it was the realtor and not the lending agency that declined you?
I'd bet it's equally likely that the lending agency sold your name and info to other financial institutions.

edit: Hasn't this happened in the past where someone here was signed up for stuff they didn't want? The "victim" was able to obtain the IP address of the computer used to sign up for the "spam" from legitimate companies? If it's at all possible that you could obtain the IP address of the computer used, track it down!
 
I smell a lawsuit. Sandra's manager has NO RIGHT submitting your personal information to various places like that. If you can somehow trace it all back to him, he is in serious trouble and you could be a rich man. Consider your next townhouse on him!
 
I def cant afford the money or time to contact a lawyer, I?m scared of a stronger reaction from him aswell then 🙁

I am in the process of contacting the BBB I figure that?s the best I can do, I have turned my cell phone off and hopefully it will die down soon, that?s only short fix I can think of.

I?m positive its them, because when I told Sandra what was going on she didn?t even deny it she said she would take care of it.

DrPizza Im gonan contact lowermybills.com and tell them what?s happening, since I am a computer geek, maybe going that route of obtaining the IP address and contacting his ISP is my best bet. I just get worried and confused when it comes to lawyers, no good can come of such a small situation involving lawyers.

Ill keep you guys posted if something positive happens.

I just cant believe they would go through such lengths to make me miserable I mean its just not a nice/right thing to do. I mean we all joke about stuff but actually going out of your way to cause somebody else problems, can u imagine that? that?s so low in my eyes. I mean he sits there typing in all MY information and submitting it.
 
See if you can get the IP address of the people who signed you up at lowermybills.com. Try to verify that it is the realtor/firm -- it shouldn't be too hard.

Oh yeah, I would also ask for your money back, and if the problems continue, call a lawyer.

oh yeah money was no problem, she said she voided the check and mailed it back to me when we spoke last week, should be here anyday, if its not already in my home mailbox.
 
You should try to find definite proof of who is submitting your info. The sites "spamming" you should cooperate with this to some extent if you explain this situation.

If you can *prove* that the realtor is doing it, you should definitely file a complaint with your local board of realtors and ask them for advice. It sounds like you were being treated very unprofessionally, which is NOT the experience you should have dealing with a licensed realtor.

You should understand that realtors have to deal with non-serious buyers a lot and it can be a major hassle to them. However, that is definitely not any excuse for them to treat you that way. And in fact, your realtor should have worked with you to do some basic counciling of your financial situation to help you understand what you probably could/could not afford. Now if you went through this, and neglected to disclose some key info (like having unusually high debt, or inflating your salary, etc) then their anger is understandable - but even so should not have resulted in that kind of treatment.

Good luck, but don't assign blame unless you know where it is happening. For all you know it could be the sellers themselves trying to sign you up for these things. Also, everybody has bad days - but man, that's a terrible way to treat a client.

PS: Just being curious, how far out of whack do you think you were? IE were you applying for a $200k loan when the bank says you're good for $150k, or what? Or are you still really not sure at this point?
 
Its just that Im a young guy, Im 24 and I got a great job recently. I have no debt but I have not built up enough credit and have no collateral so it seems that its gonna be tough getting a loan. This time I was going through a friend who pretty much gauranteed me that everything was going to work out with the loan which it obviously did not.


I am almsot 100% sure its the manager (maybe Sandra as well) sending out my info, my friend/loan company would never do this, they have no reason to. Sandras manager, whose name is Sean, was VERY hostile with me and I understand that they are PO because I honestly did feel bad about wasting their time she must have spent at least 4-5 hours showing me around over the past 2 weeks, but come on this was unnecssary.

I just want it to stop I dont want revenge I understand they are upset, because it does seem that I wasted their time, but these people keep calling and if I dont call back to tell them Im not interested they keep on following up every single day 🙁
 
Seems pretty simple from my position.
Talk to attorney
Talk to lowermybills.com, say you have a lawsuit and need the IP of the poster who submitted your info
Contact the ISP of the IP and tell them you have a lawsuit and need the info of who that IP belonged to at the time (May need your attorney to do that)
Problem solved. If everything goes smoothly you'll know within 24 hours who submitted that info.

Now wasnt that easy? 🙂
 
Im actually thinking about calling and offering to take them out to lunch and have a sincere talk with them, maybe that is the best and simplest way to stop all of this. That's what one of my friends is suggesting.

Why would you do that? They are annoying you so you buy them food? Come on. If anything go in there and let them know face to face that you don't appreciate whats going on.

By the way, what's the name of this joint so nobody else gets involved with them.
