*sigh* Apparently, as a COUNTRY, we've not learned a damn thing in the past 10 years or so.

I'm talking about back to the infamous "McDonalds Hot Coffee" lawsuit. People should not be ALLOWED to sue for bullshit like this.

I envision a New America:

Guy walks into court with Documents: I want to sue the Croc Company! Look what happened!
Clerk looks at Documents: You're a fucking idiot! What did you THINK would happen if you put your child in open-toed, spongy-ass shoes and DIDNT' WATCH HIM on the escalator?

MIAMI - The family of a 4-year-old boy who nearly lost a toe after his foot got stuck in a Miami International Airport escalator in March is suing the popular rubber clogs company Crocs, Inc., saying the shoe had no warning feet could be sucked into the machines.

Lee County residents Sanjay and Marisela Prakash, the boy's parents, are seeking $6 million in damages, according to a lawsuit filed Thursday in Miami.

"That boy's toe was crushed to the bone," said Andrew Laskin, the family's attorney. "He's a child used to running around like any another kid, and now he's in a wheelchair."


It's just a fuckin toe that was nearly lost so it's still intact so uh... :confused:

Yeah seriously, You can walk without one toe, maybe some crutches for a few weeks or something, but a wheelchair?!?

True, but to be fair the McDonalds coffee thing was waaay overblown. McDonalds was actually doing something wrong - in this case it being heating the coffee beyond the specified limits of the machine to allow themselves to have to change it out less frequently. The lady was still a dumbarse, but she did have a legit beef. That being said, we should just remove most warning labels and let Darwin work his magic.

I wish lawsuits were no longer allowed, period. Stuff like this is retarded. Apparently you can sue for anything in the US, so even if you don't win, you've still costed the victim thousands of dollars and lot of hassle, and probably destroyed them mentally for having to go through that, if it's an individual as opposed to a company.

Also, this lawsuit was clearly staged. Didn't this happen like a few months ago? The parents probably saw the opportunity based on the past case then decided to give it a try.

Yeah I found this funny as well. They probably did it to get sympathy from the judge. Once they win the suit he'll be walking like normal. Yes it sounds painful what happened, but it's not really the fault of crocs, or the escalator company, or the airport. Accidents do happen, and people need to learn to be more careful. Aka use common sense. Don't shove your toes right at the end of a moving metal part.

Status quo. The more that things are complicated and redundant the more the courts, lawyers and judge make and have stupid stuff to do.

Making sense and common sense have no place in environments with such.

How about you watch your child when he is on something that could possibly hurt him. My parents used to hold my hand and make me jump over the end piece of the escalator. It was a fun way to teach me that that part could be dangerous and to make me avoid it all together.


Some people are good parents, some people are bad parents. I figure it's the 80 / 20 rule. 80 % of people are good to great parents and 20% suck so badly they should have their children removed from their care.

If we really want to stop frivolous lawsuits it's easy. In addition to fining those who bring frivolous lawsuits, fine the lawyers who file them. I guarantee they'll stop overnight!

I do recall reading about a similar incident involving a mall escalator, although this was probably years ago.
