RANT - My Tenant Has Not Paid Rent For Two Months

does not pick up our phone calls. I will have to start the eviction prociess, but that can take 3 months. that means I will be out on 5 months rent. I hate people who have no sense of responsibility.

I don't understand why the law prohibits us from cutting off water/electricity. This is no better than stealing.

say something "accidentally" breaks, like a water line or an electricity line. Your tenant will have to complain, right? And of course it wasn't your fault because it was "accidental" and "you never knew about it."

Why does the eviction process take 3 months? Does that mean he gets 5 free months of living there?

how long have they been tenants? what kind of pay habits did they have? were they always late or is this the first time?

yeah, but i bet they won't. if they aren't responsible enough to pay their rent, they probably won't even know how to sign up for water service. there is usually a main valve in the box by the street with the usage meter. shut that puppy off! :D

well, you are legally bound to follow the eviction process, but there's nothing like good old fashioned changing the locks, padlocking the door, and moving his stuff out to the curb and 'accidentally' forgetting to send him notice.

since last october. my property management has always been able to collect rent on time until the past two months. by the time the eviction process is over there lease will be over. these ppl seriously suck.

I thought I can only give them 30day notice if they were on a month to month lease? My tennants aren't due out until October.

You can report it to the credit bureau... not that the guy would have stellar credit to begin with if he does crap like this. At least that may raise some flags for his next potential landlord...er... victim.

Unfortunately most cities/states have laws which protect deadbeat tenants way more than landlords.

QFT - Do this and call the guy letting him know that you are doing this unless you pay up. Also let him know that this will show up on his credit report for his future rental places to check.

If you hadn't waited 60 days after the tenant missed his first rent payment and had instead filed immediately this situation would already be dealt with.

This goes beyond a lack of responsibility. This is an outright theft.

In addition to eviction you need to file a small claims suit for the rent they owe you. You'll win. They won't pay. Then you submit it to collections and make sure it shows up on all three credit reporting agencies.

You should also post a notice of inspection on the front door. In my state (and I think it works like this most other places) you have the right to enter after a you give 24 hours of notice. You can do this for any little excuse. Call it a lightbulb inspection if you want to. Say you need to install a new smoke detector. Whatever. You need to do this NOW so you can get inside and see if they have caused any damage to the unit. If they refuse you can have the Sherriff come with you and force compliance.

If there is excessive damage you may be able to win an injunction and have them removed immediately.

Our laws are heavily favored toward the property owners up here. Hope things work out for you.

Oh, and don't forget to tell him that the court records will show up on UD registry, Saferent, etc. This will have him blacklisted, and he will never be able to rent another apartment (at least without a major hassle). This will apply even after it falls off of his credit report.

The water is in your name? Perfect. Find out what the rules are before you do this... but post notice that as of XX/XX/XXXX date (asap) you will no longer carry the water in your name and the tennant will have to transfer the water to his name.

My mom had this issue with some people that were renting out our old house. Took forever to get them out of the house. Our legal system sucks.
