rant! due to clerical error no restitution from guy who stole my car: video inside

i made a thread a year and a half ago about my car getting stolen and the teensafe camera installed for cheaper insurance for my kid captured the dickhead when he hit a speed bump too hard a block from my house.

I haven't had a update from the sheriffs office so yesterday i called him. turns out dickhead car thief has been locked up in canyon city since november!!! the detective said i could call the DA's office and try to get restitution out of him.

$140 to get car out of impound to start with then replacing shocks and struts and getting the interior cleaned because it was abandoned for a month with the window down...

anyway i called the DA and they told me they sent me a notice. well i never got one and she read off the address. the fuck tards at the DA had my house and street number correct but sent it to the wrong fracking city!! the lady at the DA's office said she would have one of the lawyers call me.

i just got off the phone with mr. lawyer and there is a statute of limitations of 90 days for victims to claim restitution. he said he understands it was a clerical error but with the law there was absolutely nothing he could do. he did say i could file a civil suit against mr dickhead car thief and he would assist me with providing all the paperwork i would need.... GHA!

fuck it then,, im done with this. the dickhead car thief is in jail so im happy with that but im still pissed im the fucking victim here. that fucktard cost me a lot of money on top of that he stole the car the day my mom passed. sure he is in jail but it would be nice if i could hit him in the wallet like he did me.

You probably wouldn't get any money out of him anyways.
Just be happy he is probably serving 5-10 for GTA and whatever else they charged him with.

File a lawsuit (pro se), get a judgment against him, then lien anything he owns, or sell the debt to a collection agency/attorney...at least you'll get something...and screw the guy over a little more...too bad you can lien their government welfare (which I assume he'll be on when he gets out)...

Wow, that sucks.

Reminds me of a few years back due to clerical error I owed back car taxes in because each time I went there to pay they looked it up and couldn't find any info on it so stamped me ok to register the car. Turns out it was filed under my mothers name (at the time she co-signed the car loan) but even though I tried to pay for two years I owed compounded interest when they finally figured it out.

You'd probably get more money out of suing the DA's office for being boneheads that can't get something as simple as a mailing address correct, which caused you to miss the 90-day deadline.

Of course, you'll have to live like a saint after that! ():)

Seems like he should be able to file a claim with the city/county over the clerical mistake. If they don't pay/don't accept the claim, take them to small claims court.

Of course, there's at least some fault on the OP for waiting so long to contact the sheriff over this as well...

Sucks for you. Learned your lesson?

On older cars it doesn't make financial sense. I've got an old minivan where full coverage would cost 50% per year of its blue book value. It's got no problems and runs great, it's just that the book value of the van is almost nothing. There's no point to pay for full coverage but I'd still be pissed if somebody stole it because I'd probably have to spend 3x as much as the car's book value to get something that ran as reliably.

exactly the car was worth about 1100 at best. it looked like shit but it ran great. there was no reason to carry full coverage on it. i have other cars so i wasnt stranded or had to rely on a rental car.

he had other charges. when i took the vid to the sheriffs dept, the detective recognized him right away and the fuckers mug shot was right there on his desk.

the dark spot under his eye in the vid is not a black eye. its a tattoo. over his eyebrow it says FUCK and under his eye it says COPS.

the boy has a history and the fuzz was already looking for his sorry ass.

You're supposed to feel sorry for the thieving bastard because his father didn't tell him "I love you" enough or he didn't have any rich banker uncles in life to indulge his every desire, you know....like all the rest of us do.
