WASHINGTON (Reuters) - The U.S. Supreme Court (news - web sites) cleared the way on Monday for civil rights icon Rosa Parks to proceed with her lawsuit against OutKast and others over the rap music duo's hit song with her name as its title.
Parks, a Detroit resident, sued in 1999, claiming use of her name without permission constituted false advertising and infringed on her right to publicity. She also claimed it defamed her character and interfered with a business relationship.

A federal judge dismissed the lawsuit in 1999, ruling constitutional free-speech rights under the First Amendment covered the use of Parks' name.

The appeals court upheld the dismissal of the claims of defamation and interference with a business relationship, but reinstated the rest of the lawsuit.

It said the defendants needed to show some artistic reason for calling the song "Rosa Parks." The appeals court sent the case back for more hearings to determine whether use of her name was symbolic, as the defendants argued, or disguised commercial advertisement.

It is true that the phrase "move to the back of the bus" is repeatedly used in the "hook" or chorus of the song. When the phrase is considered in the context of the lyrics, however, the phrase has absolutely nothing to do with Rosa Parks. There could be no stronger, no more compelling evidence of this fact than the admission of "Dré" (André "Dré" Benjamin) that, "We (OutKast) never intended for the song to be about Rosa Parks or the civil rights movement. It was just symbolic, meaning that we comin' back out, so all you other MCs move to the back of the bus." ? The composers did notintend it to be about Rosa Parks, and the lyrics are notabout Rosa Parks. The lyrics' sole message is that OutKast's competitors are of lesser quality and, therefore, must "move to the back of the bus," or in other words "take a back seat." We believe that reasonable persons could conclude that there is no relationship of any kind between Rosa Parks' name and the content of the song -- a song that is nothing more and nothing less than a paean announcing the triumph of superior people in the entertainment business over inferior people in that business. Back of the Bus, for example, would be a title that is obviously relevant to the content of the song, but it also would not have the marketing power of an icon in the civil rights movement. Choosing Rosa Parks' name as the title of the song unquestionably enhanced the song's potential sale to the consuming public.

Unless she patented the phrase "Move to the back of the bus" then her lawsuit is worth it's weight in toilet paper. Her name and actions entered into the realm of history and celebdom when she refused to "Move to the back of the bus".

This lawsuit is giving a great big old black eye to her civil rights actions

That was about 50 years ago when blacks were not allowed to have high paying jobs in the South. I don't know what she is doing now, but she was involved with the NAACP during the bus incident, she was working at a department store prior to that.

"Parks was not the first to be detained for this offense. Eight months earlier, Claudette Colvin, 15, refused to give up her seat and was arrested. Black activists met with this girl to determine if she would make a good test case ? as secretary of the local N.A.A.C.P., Parks attended the meeting ? but it was decided that a more "upstanding" candidate was necessary to withstand the scrutiny of the courts and the press. And then in October, a young woman named Mary Louise Smith was arrested; N.A.A.C.P. leaders rejected her too as their vehicle, looking for someone more able to withstand media scrutiny. Specifically a elderly black women in Fort Worth TX a couple years before Rosa Parks. And let me tell you Fort Worth has one of the most sordid past of violent racial conflicts between whites and blacks.

The producers apologized for the scene but would not agree to alter the version of "Barbershop" shown in theatres; they also refused to delete the scene from future DVDs as his most Reverend insisted.

The scene which "Big Brutha" called to be scrubbed and forever forgotten was a particular one in which comedian Cedric the Entertainer blasphemed a few 1960s icons now worshipped at the holy alter of Political Correctness. According to an internet news forum, it went like this:

The character of Cedric the Entertainer - the portly older barber, for those who have seen the previews - went on a tirade against every liberal black sacred cow you can think of. Here's a paraphrasing:

"Black people have got to stop lyin' to theyself! (SIC) These three lies in particular: One, Rodney King was drivin' drunk at a hundred miles an hour and deserved to have his ass beat! Two, O.J. did it! And three, Rosa Parks didn't do nuthin' but sit her tired, black ass down!"
