Random artifacts with (Connect3D) X850 XT PE?

Ok, my card is not overclocked, the option isn't even unlocked in the Overdrive menu. And in a lot of my games: F.E.A.R demo, GTA: SA, Chronicles of Riddick, Far Cry, ect. I get random artifacts that just get worse and worse untill the VPU recover thing has to be used, this happens way to often.

I'm sick of it, does this stupid card just get too hot for the fan to keep it cool or what? Or maybe I just got a bad apple?
 
get an RMA since the warranty should still be there. I think the card just needs some new TIM and a HSF reseat.
 
I got it OEM from Monarch, is there a warranty for OEM items?

EDIT: Mmmm, I see on ATI's site there is no warranty for OEM items. But I still might be able to get it serviced because it says "Built by Ati" in the Hardware Information....
 
I underclock my x800xt-pe by 20mhz to avoid artifacts, some cards just slip though testing without being fully up to the task. Monarch might RMA the card, I'm not sure what their policy is.
