Radeon 9800NP replacement has BIOS overclock

Today I received a replacement for my dysfunctional Radeon 9800NP (~325MHz GPU / ~290MHz Mem) from ATI.

What's awkward is that my new 9800NP is clocked @ 378 = ~380MHz GPU and 317.25 = ~320MHz Memory by default. I thought this might've been some bug in RadClocker so I downloaded/installed Rage3D, PowerStrip, etc. which read the same frequency.

Any ideas?

Did ATI sent me back a overclocked card on purpose or did I somehow got ahold of a card that was soft-modded by the previous owner(if there was a previous owner)?

P.S. Also checked the serial # on the card and according to ATI, it's a 9800NP.
 
I'd keep the card and test the he11 out of it but I'd also call ATI and notify them so they don't think you did it.

FWIW, I've got a Sapphire 9800NP that's been absolutely flawless as a "flashed" Pro.
 
I was thinking about the 9800NP > 9800 Pro flash but this one has Infineon ram 🙁

Gawd hope it does but will test to find out for sure.

If it fails then yet another week of RMA turnaround.

EDIT: So far in some games and Aquamark everything seems to be in order, still awaiting email from ATI though.
