Quick ebay ethics question from an old timer

A few weeks back a power surge blew out one of my two gigs of Ballistix pc2 1000 memory so I quickly ordered another on abay. I get back from a two week trip to find emails from the guy hurrying me to leave him feedback. I toss the ram in and use it for three days without a single issue yet I don't actually test it. On the fourth day I feel comfortable enough to leave the guy pos feedback and not three hours after leaving feedback my machine starts crashing randomly. I test the memory with memtest and sure enough errors run rampant. SO....
Am I shit out of luck or should I complain to the seller?
The product was bought used.

IMO, you waited too long to test it. Should have waited till you got back from the trip to buy it.

To be fair the trip was the result of an emergency medical situation and was unexpected.

Who made the ram? Might have a warrenty on it.

Also since it worked fine when you put it in then several days later went bad could be your system damaged it.

Crucial has lifetime warranty on their stuff I believe.

I dont believe those kind of warranties are transferable from the original seller

I have RMA'd crucial ram 2 or 3 times and they have never asked for any kind of reciept. Not to sound dishonest but I don't think I would mention the fact that I purchased it second hand on ebay.

ebay doesn't work like a merchant unless the seller wants to extend that to you.

I'd try to RMA the ram with the company that made it...should have a lifetime warranty on it.

QFT, I have never had a problem or have heard of one with Crucial replacing any RAM they have made due to issues. They are a solid company.

Thanks everyone. I will take the consensus advice and attempt a Crucial RMA instead.

If you paid with PayPal, you can file a SNAD with them.

The fact that you did leave + FB might hurt your complaint. But, if you paid by a CC you can take it up with them.

If the RAM is genuine... there have been LOADS of knockoffs lately, lame I know... then just RMA it and move on. If the RAM turns out to not be genuine, then you have an entirely different issue.

but, whatever you do, do it immediately. There is a time limit on when you can file a SNAD.

Memory errors are not proof positive that the memory is bad. Have you checked that it's running at the correct voltage? That power surge could have damaged more than that memory stick. I suggest you test that memory in a known good system and make sure the voltage is set correctly.

The voltage is set correctly. The stick is nearly identical to my other stick and both run at 2.2v & 1066fsb. I have tested both sticks in multiple slots running one at a time and this stick continually comes of with errors and gives me bsods. Yes I am positive the ram is bad. Whether or not my system caused this I have no idea.
