Question and rant about speeding ticket

Just a warning, this is a rant, so feel free not to post if you don't like it. Or if you do post, at least read MY entire post :)
Another note, units are in KM, not MPH. 100km/h = 60mph.


I was driving down the ville-marie expressway tunnel, which is an 6-8 lane highway which runs underneath Montreal. I thought the limit was 100kmh, as I was driving at about 105-110km/h (no cop would give you a ticket for that in a 100 zone) and I was going only slightly faster than the rest of the traffic, so just about everyone was going 100 or so. (Today I was going the speed limit in the exact same tunnel I was just talking about. Cars were whipping around me left and right, which isn't fun at all.)

Now, at the end of the tunnel there are no less than 10 cops by the side of the highway and a few cops standing in the middle of the highway waving people over with orange batons. I get waved over, as do a few other people (I'm guessing at least 5-10 waved over every minute). The cop comes and tells me I was doing 121 (!!) in what is actually a 70 zone. I was amazed, as I was sure I kept my speed under 110, which in a 100 zone wouldn't even get a cop's attention (except sadly the tunnel is only 70) (As a side note, while driving on the highway today following a friend he said we were going 120 - 130 when my speedo indicated 110 - 115 so I might have accuracy problems at highway speed).

Now, the ticket resulted in being 5 points. As I only have a 4 point license, paying this ticket means I lose my license immediately for 3 months. I also have another 3 point ticket I got within the first week of having my license that I contested, but haven't gone to court for yet. Add the points together and I lose my license TWICE, for 6 months!! I don't even want to look at what it will do to insurance.

It really irks me because I was driving safely, about the speed of the other traffic, and I could lose my license when I have friends that drive 140 in 50 zones while drunk, put their cars in ditches, etc.. and have lost no points or only 2-3. That was a mass raping what those cops were doing in that tunnel. I don't feel I should have to lose my license and pay donut money when I wasn't driving in a manner that wasn't unsafe. I'm wondering if the cops didn't clock someone else at 120 and put it on me by mistake because I don't think everyone was going 120 in that tunnel!

To add insult to injury, the cop put my speed down as 121 instead of 120 making the ticket 5 points instead of 4.

I'm considering getting a traffic lawyer to fight this. If you've gotten a radar ticket and succesfully fought it by yourself or a lawyer I'd love to hear about it. If you wanna rant about your own unfair tickets this is the thread to do it! :)

I don't think you were meant to drive after hearing all the horror stories of your car, near accidents, and your speeding tickets.

what near accidents? No more than anyone else experiences. Unless you're talking about the curb in the parking lot.. but that was just stupidity.

All the horror stories are cause I bought a cheap car ;)
This is only my second ticket.

I thought you had a near collision on some wet road on bald tires, and another near wreck with some farm equipment or something.

Also, two speeding tickets in what, a years worth of driving?

Hmm not sure were u are, but I am pretty sure u are not in USA. Dose the excuse I was going the speed of traffic and if I were going slower, which u would have to if u were to go speed limit would impair the traffic. Putting u and other driver in danger of getting in to accident. For future, if radar detectors are not banned were u are get a one it will safe u from allot of ticket especially the one u described.

with farm equipment??? lol, I don't remember anything about that. I don't live in the country. Uh, the first couple days or so I had my license I nearly hit another car in the back when skidding, but hello, wet road, crappy tires, and inexperienced driver!! Overall I've had less trouble than most people I know (including those who are very good drivers today).

Today I was going the speed limit in the exact same tunnel I was just talking about. Cars were whipping around me left and right, which isn't fun at all. Unfortunately, radar detectors are illegal (not just banned but illegal) over here and the police can and will confiscate them if they catch you with one.

Get a lawyer. Also get a radar detector, if it's still illegal in Quebec get one of those hidden stealth ones. Of course posessing a radar detector where it's illegal can result in a fine and possibly points so if you use one don't come complaining to anyone if you get caught with one.
I'm not too fond of Quebec's traffic enforcement myself. This is why...
Under special agreements, traffic convictions in Quebec or Ontario are recorded on NYS driver license records and carry points. Except for violations in Ontario and Quebec, points are not added to your NYS record for out-of-state violations.

Anyways get a lawyer or be prepared to park your car for 6 months.

you see, cops have a quota that they have to fill on murders and speeders. once they fill their murder quota they immediately work on their speeding one.

your ticket didnt happen to be at the end of the month, did it?

Not much sympathy here is there! not very experienced driver + speeding = dangerous person on the road. It is time to go back to Sears and get back your money for your drivers liceince.

I hate to sound callous, but you were speeding. You were breaking the law. Saying that everyone else does it is no excuse. IIRC, cops do not have quotas, but writing alot of speeding tickets is one way to get noticed for a promotion.

Now, with that out of the way, here is my advice: Contest the ticket, get a lawyer if you think you need to. You may lose, but some chance of beating a speeding ticket is better than none. Always contest your tickets. Maybe you'll only get out of a few over the course of your life, but it's better than having those extra few on your record.

Do be prepared to either park your car or drive illegally for awhile.

If you were watching the cars infront of you would have seen every slame on there brakes and know to slow down.

Tough sh*t. I have had enough tickets in my life and dealt with it. If I were that close to losing my license I would have never gone over the speed limit and been more aware of the speed limits. Being ignorant of the speed limit is not an excuse.

You will learn the tough lesson. Maybe if you had learned from your past mistakes this wouldn't have happened.

EDIT: Two years ago I was within 4 points of losing my license. Guess what? I never went over the speed limit until 3 of my tickets dropped off my record this year.

hey everyone, we have a regular sherlock holmes here. how, oh how did you figure out he's not from the USA? was it the KPH? was it his location, plainly stated in his profile? or maybe it was where he specifically states "montreal" as his location. ;)

As I said, I was never really going faster than the other traffic. Near the end of the tunnel I was going less than the speed limit because it was the end of the highway (so was everyone else), like around 50 or so. It was the speed I was going while inside the tunnel that I was busted for.

I don't think it's dangerous to drive at the same speed as everyone else on the highway. I found it dangerous today in the tunnel when I was going the limit and people left and right were swerving around me like the slow driver I was. They really need to raise the speed limit there. I don't care about driving slow in school zones and the like, but donut money traps p!ss me off.

Well, I did slow down a lot after my first ticket. I didn't slow down to the point where I had cars swerving around me, though. By driving at about the same speed close to what I thought was the speed limit I figured I was safe.. but I got caught in a nasty radar trap. I've never seen anything like it, with over a dozen cop cars by the side with cops in the middle of the highway pulling people over. Is this just a Quebec thing or do you Americans also have expressways change from 100km/h/60mph to tp 70km/h/40mph?

I'm definately gonna fight it.. worst comes to worst I'll be stuck taking the bus for a while. Hopefully that will be during the warm months, as I won't care so much then, but lately with these -26 days I don't feel like getting frostbite ;)

Well here is the question that needs answering. Do you have extra money to spend on a lawyer? If so then hire one and you won't lose your license. But it will cost a good bit of money. So it all comes down to how much you want to keep your license.
