Question about visas (not the credit card) (anyone work for INS?) ;-)

Ok so heres the deal, my friend is originally from Canada and obtained a student visa to come to the US. After being here 2 years or so married an army man, got pregnant, and had a child. Well flash forward like 2-3 years later. She hasnt been back to school in 2 years or so and is now getting divorced as he turned out to be very abusive. The son is a citizen as he was born here, the army guy is as well. As far as she knows his lawyer is trying to get her basically deported when the divorced is finalized. If this happens she loses her son cause he isnt allowed to leave the country with her for whatever reason. This is what I've heard from her and I was wondering out of the 10's of thousands of people that read here every day if any of you had any ideas.
 
She had better talk to a immigration lawyer. I have been through the whole INS thing coming from Canada and I know it can be tricky. Its probably even worse now since 9/11, its not called INS anymore by the way. I figure when people are talking deportation and losing a child its time to talk to a proffesional.
 
Ah I see, appreciate your reply. Any more details you feel like providing would be cool, just trying to learn about this crap (btw shes a single mom and claims she cant afford a immigration lawyer).
 
If the son is under 18 and a US citizen, I don't think she will get deported. She was married to an American and lived her for a long time so my guess is that she has legal residency. In all this time that she was here... did she apply for Citizenship or legal residency or a gree card or anything.

Have her talk to a lawyer about...the childs habitual place of residency...

Dunno, but I have a hard time believing that the US government will deport anyone soley on the request of an unhappy spouse.
