Question about responsibility during a transaction

I am currently in a deal with someone who shipped a relatively expensive item to me. He shipped this item via usps but i don't believe that he shipped with insurance. Anyways during shipment the item was damaged because of the poor packing of the item (i.e. not enough packing around item in too small a box). Now this item is no longer of any use to me. After multiple attempts to contact the person via email, the person i was dealing with said that its out of his hands now and that I have to deal with the postal service. As far as i'm aware the person that sent the package is the only one that can do anything. And since i don't believe he shipped with insurance the postal service will not do a claim on it. In the post that he made he stated a Non-DOA warranty. My overall question is who agrees that i deserve the right to ask for a full refund of my money? I mean in good faith i bought and item that was stated in good working condition with a Non-DOA, but when i recieve the item it doesn't work as stated. Any feedback would be appreciated.
 
The person you dealt with has the responsibility to get the product into your hands, undamaged and working. Now the person took it upon themself to opt out of using insurance, then it is not a Post Office issue, but a seller responsibility. He chose to be self insured when he decided not to buy insurance. MY policy is generally, if less than $100 I am self insured, over that I buy insurance. In either case, I take responsibility. If something that I ship is damaged, I cover it (I don't make the buyer wait), then claim it with the post office.
This Post Office is not going to do squat and it will untimately fall back on the seller.
 
my policy for insurance is anything over $50 i insure for up to $100. its only .85 cents so why not. everything i ship is done with confirmation no matter the cost unless i ship to canada. hell its only .35 cents. that extra dollar or two saves a lot of headache if something goes wrong during shipping. all i have to do now is wait for him to email me back (which takes him forever). thanks for your support compuwiz1. 🙂
 
seller is definatly responsible here! I think as a service to all the traders here you should expose this person, or at least threaten them with it and see how fast they change their mind on responsibility!

Get him buddy! And I agree 100% with compuwiz1..The seller assumes all responsibility, especially if they refuse to insure, AND claim not to be DOA!!

thanks for all of your feedback on this, but threatening this person will only make it tougher for me to get my money back. i'm trying to resolve this situation with him without resorting to threats. he emailed me back the other day and i thought that this situation was going to be resolved peacefully, but now he's claiming that i am now changing my story and that i am just now claiming that the damage was done during shipment. i emailed him 15 minutes after i opened the box!!! and left a post for him. took him like a day or two to even respond to the email. now he says that if i can't confirm with the post office that it was done during shipment than he's not gonna do anything. the thing is with the post office they won't even look at the package for damages unless there was insurance on it. so he's like without PROOF that the item was damaged during shipment he wasn't going to do anything. i would think emailing him 15 minutes after i opened the box, sending him pictures of the damaged item and the lack of adequate packaging of the item to be enough proof for him, but i guess not. he know wants to use a free mediation service to resolve this situation. i guess we'll see what happens with that. any wanna be an impartial mediator? 😉
 
just as a follow up i am now filing mail fraud charges against this person and his father for misrepresentation of product/service. he wanted to play hardball and had his dad email me saying that he wasn't in the position to "fix" this situation since he was a minor. :| oh well. i guess they have to learn the hard way on how to honor their doa warranty.
