Question about medical malpractice

I went into the hospital because my ass was sore, I inform the triage nurse(after she asked) that I had falling while shoveling a week or two prior. After waiting 45 minutes to see a doctor he comes in, says I probably bruised my tailbone but he would xray to see if I broke it. ***He never even looked at it***, he wrote something on a piece of paper and handed it to me and walked out. After another 20 min the nurse came in and asked if i was going to xray, I said I think so. She gave me directions and off I went. I assumed i was supposed to give them the paper the doctor wrote on, after I did they handed it back and said "This is a prescription, we don't need this, you do." After the xray I went to the pharmacy and got the tramedol prescription filled for pain. I called the hospital back and they said my bone was fine so I just needed to rest for three day and not work.

A few days later I was still in a lot of pain so I went to a different walk in, they told me I had a boil and it was positive for staph and I could have died.

My questionis how do I go about getting four days worth of pay, and a refund from the original doctor. I am not seeking pain and suffering i just think its fair that they pay my lost wages and reimburse me what I paid them.

Am I being unrealistic?

Your boil developed enough to be more easily seen over the three days. Based on your history, the first doc seems to have done the right thing. You aren't a car to put on a lift and take apart until they find something.

Sucks, but you aren't going to get a dime.

Is there any evidence that a boil was visible when you first were examined? If not, then youre hosed. The doc will say the initial symptoms were caused by the fall, and then the boil developed later after you left.

You came in complaining of a sore ass, and said you fell a few weeks ago, leading the doctor to a hurt tailbone and possible break. Going on what you said he made a diagnosis of the most possible solution.
If on the other hand, you hadnt mentioned the fall, he might have done an inspection that may or may not have found the boil.

I dont see you having much of a case against him.

The boil was clearly visible, red, hot and huge. The first doctor never look at it or examined it.

I mentioned that i fell weeks ago after they asked. Someone should have actually looked at the sore. He never did, he was in the room for less than two minutes.

Should have been more forceful, or persistent with having him check it out.

So you're saying its unrealistic for me to ask for my money back? Because I didn't insist he look closer? I don't think I should have to, that's what I was paying them for, next time I definitely wont be as trusting, but I fail to see how this is my fault, I went in, answered all of their questions and they botched the diagnosis with shear laziness.

I shouldn't even dignify you with a response but I shower daily, sometimes twice a day, and I prefer real women, you know, real live women. We can't all be virgins shut ins with lifer status and webcams.

More or less yeah it would be very unlikely because of that.

Still odd they wouldn't have checked after the x-ray showed nothing though, but they did treat for the most likely cause which is what most things end up being.

Probably its best to just give symptoms and leave out past events when going to the doctor, unless you are relatively sure of something specific, which will cause them to have to do several tests.

His lawyer would bring up your fall which was a red herring and would ask you why you mentioned it while completely ignoring what you knew to be the problem.

Should someone have looked at the area? Absolutely. Should you have given them a clue to the real problem, and they should have figured that you weren't bright enough to tell them what you knew? Yep.

You would have to look the judge in the eye and say that you didn't know a huge festering blob of pus might have been responsible for your discomfort.

That's going to be a hard sell.

The boil probably wasn't even visible at the time according to you...and in all fairness you should have known it was something other than the fall.

If you are looking to sue someone (and no attorney is going to take a case for a day's pay), try harder.

Next time you are with a doctor and are confused be a man and just speak up.

You need to get the doctor to admit he made a mistake and then he will refund your money and pay your losses.

I told them it was red, swollen, hard, and hot. I didn't know what a boil was until the second doctor visit, obviously I would have told them if I knew. And it was huge, but there was no pus, still, even with the absence of pus the second doctor knew it was a boil right away, I'm certain the first doctor would have too if he took a second to look at it. I understand that in WI they probably see a lot of tailbone injuries this time of year, but that doesn't excuse them the due diligence to look at it.

They asked if I fell, I said a few weeks ago, should I not answer the doctors questions honestly? And I'm not looking to sue, I just don't think its fair that I have to pay for the doctor visit when he was so lazy.

Not to mention who writes a prescription without telling the patient what it is or asking me if I was on any other medications?

When you say you went to the hospital, where did you go? The ED? Also, you're saying you told the doctor to his/her face that you had a huge, red, hot, painful area?

I'm the first person to rant against sue-happy people, but OP has a point. Why should he have to pay bills for a service that was not rendered? Clearly, the first doctor didn't even do a basic investigation on what might be going on.

Realistically you don't have a case strong enough to be worth going to court over, but I'd say you deserve your money back for lousy service at least.
