Question about auto accident liability

I had an accident which I posted here a couple months ago. I received a call from the other parties insurance compnay "Geico" to settle the accident claim. I had to fight with them directly as I only have liability on my car which is totalled. Anyway, they say since it is my word against his word (determine which person had the green light and red light) they are offering me 50%, also 50% of $500 storage fees which I had to pay out of my pocket. I think this is BS because I had a witness stating that I had the greenlight but geico disputed and said the witness statement is not inclusive. I know it was the other parties fault the guy was 70 years old! I have been going the same path, when I had my, for over a year and I didnt sign a death warrant to skip a red light on a busy intersection. I know I am entitled to 100% is there any way that I can get geico to give me 100%, anyone have experience with this situation, please help. Thanks.

Shouldn't your insurance company be the one dealing with Geico and not you?

Unfortunately, case law supports what they are saying. Unless you can find some better evidence you're screwed. I doubt you'll find an attorney willing to take this case either, unless you've got some big bucks and want to fight it as a moral issue. You'll lose in the long run because it'll cost you a hell of a lot of money.

Your best bet is to try to talk to the adjustor's supervisor or file a complaint with the state insurance commissioner, but it's really just an exercise in red tape and bureacracy.

Since I only have liability and not full coverage they told me that I must haggle with geico to recover my losses. My insurance company is Allstate.

Not if he had liability only. They have no contractual obligation to work with him since he doesn't have collision coverage.

Kinda makes collision coverage seem cheap now, doesn't it?

Yes but I had 4 witness's on a police report saying she ran a "Definite" red light. And I had to wait 6 months to settle the claim because her traffic violation ticket was pending (she was fighting the ticket, I had to wait for the court date) .

Insurance companies love to talk down liability in %'s .

#1. Did the other automobilist receive a traffic violation?
#2. What did the witness state on the police report?

I too did not have collision on my car, so I had to handle the claim all by myself. This is what I pay 3500 a year for!

I'm also a All State Client in NJ. I just got dumped from them because I never returned my questionnaire they snuck into one of my billing statements. And All State didn't fight for me because of current NJ laws that suck, and because they know they don't have to pay for damages to my car.

I too did not have collision on my car, so I had to handle the claim all by myself. This is what I pay 3500 a year for!

#1. No I dont think that he received a traffice violation as he was taken to the hospital.
#2. The witness comments were not posted on the police report only his contact information.

On the police report it will show if he got a summons or ticket. Usually just a series of numbers you have to look up on the net.
