Situation:
I'm wanting to apply for a family plan for ATTWS GSM. I'm currently an AT&T customer on their TDMA network with 2 phones. My phone's contract expired yesterday and my wife's expires on November 1st. Both phones are in my name.
I asked A1wireless if I would be able to apply for the GSM family plan. I don't want to keep my number so that isn't an issue. She told me that if I want to apply, I have to keep my current phones active for at least 181 days.
Does that sound right? I wanted to get the Nokia 6620 and AT&T will give it to me for $399 - $100 MIR for each one. (little expensive there)

So basically my question is is the CSR correct by telling me that I have to keep my current phones active for at least 181 days or I'll be charged a $350 fee for cancelling (I told her I won't be in a contract but I don't know if she understood that)

I would think she's wrong or doesn't understand your question.

If you can live without wireless phones for 90 days, cancel all accounts for at least 90 days.

Then apply again you should be considered a "new" customer but I could be wrong.
