Okay, here's the scenario:

I'm at the mall, backing out of my space.. some woman backs into me (from a one way direction) like.. you are supposed to go only one way towards the mall.. she passed where I was parked.. and decided to back up to take some other space. She backed into my drivers side door with her right rear bumper. Damage was done. My door is dented in, as is my right rear quarter panel. ARG. She was trying to tell the cop it was my fault.. The cop was like.. private property, and all he did was write it up. She zoomed off as soon as it was over. I called her insurance, and it was her b/f's car and shes not on the policy. GRR


i just went out and snapped this pics.. excuse the non existant lighting. my car is fire engine red. (actually aztec red..) and there was no previous body damage at all.

Okay.. Got a couple qoutes.. $2900-$3100 ... the door skin needs replaced, as does the quarterpanel (they die grind it off, and weld on a new one..) as well as accounting for assumed internal damage to the inside of the quarterpanel... Now to deal w/ the insurance company. bleh.

Okay.. insurance claims lady called me back. The people are disputing the claim :(
the claims lady told me she in her opinion they are at fault, but she has to call the lady back (she got the story from the b/f.. who wasn't driving.. she needs to talk to the driver..) and that she will call me back. The insurance company makes me a little uncomfortable. their number was busy for awhile today :-/ ..... but so far things seem to point in the good direction. An appraiser is coming out on monday to take a look at my car since the damage is more than $1500... bleh. arg. she mentioned that it might be totalled (but I dont think she knows what she is talking about..) I already have a stock sr20 lined up.. so if it is totalled I can do another engine swap, and have a $3k engine I can resell... yay. sort of. My poor car looks so sad.

The lady is disputing the charges. Apparently it will take 3-4 weeks for a full on investigation. I think im going to wait for the police report.. and fax it to them with "How far do you want to take this?" written on it in black sharpie marker.. or maybe hire a lawyer

"Driver #1 stated that she was in the main drive between the parking space areas. She advised that she was backing up to get a parking space and did not see vehicle #2.
Driver #2 states that he was backing out of a parking space when vehicle #1 backed up and struck his vehicle."

That's what the police report says. bleh.

Good luck. I had that happen at a bank, their insurance ended up paying even though the PD's accident investigator wouldn't say who was at fault.

So if it was her bf's car and she's not on the policy, what does this mean for you? Will you not be compensated?

In most states, insurance follows the car, not the driver. As long as the B/F knew shew was driving it, and gave her permission, then his insurance should pay up. Plus she backed into you, the wrong way on a one way drive. She is clearly at fault.

Or at least threaten to.

Or take her to small claims court. No lawyer, no lawyer's fees, if you win she pays the filing costs.

Yep. The only way she would not be covered would be if she was specifically excluded from her BF's policy.

oh yeah ur right...deductible...there has to be some way that the lady, or the bf's insurance provider, must provide at least some compensation...

u can sue her, or ask for the deductible cost maybe to settle things.... get a lawyer and go to the chiropractor for your injuries ;)

No witness's , no ticket issued.... Just her word Vs yours. Her or her boyfriend's insurance will maybe pay 50% of the damage if you're lucky.

I think both of you are at fault.

One, she didn't look obviously, she assumed nobody was there and hit you.

Two, you didn't wait for the car to pass by. You rushed. And don't tell me her car was rushing by @ 40 mph passing your parked car then suddenly she hits it in reverse @ 10 mph going in reverse. As soon as you saw an object pass by your car you quickly pulled out like there was no tomorrow.

I always, specially In a parking lot, back up real slowly inch by inch until I see not one sign of a car going forwards or backwards! That is how you are suppose to pull out of a parked position any how. I feel sorry for you because I know you had no way to tell that she was going to back up like that, but thats why you have to drive extra careful in a parking lot.

The cop wrote up a police report. I talked to her insurance, and I now know she wasn't on the policy. I think that they are going to pay 100% of it, but im not 100% sure. They told me to go tommorow and get 2 estimates, and have one estimate place take unbiased pics..


The thing IM worried about is if she tries to lie about what happened. IMO it's clearly HER fault. I was backing out of my space, and granted, was not looking for someone to come from the Wrong way of the road.. but when she hit me my car was not moving. I think that makes it 100% her fault. (I didn't/could have HIT her, cause she hit the SIDE of my car) but again.. i dont really know much about these legal procedings. I'm really worried about how much/difficult it will cost to fix my car, and most of all, would her insurance pay for a rental car for me?? Cause I have NO other method of transportation. If her insurance takes 100% liability, you think they'd pay for a rental??

Whoa now.. The car passed me.. then reversed.. thus going the wrong way down a one way aisle...

i went inside the mall, and bought a disposable just for that purpose.. i made a point to get the arrows showing she was backing up the wrong way and the location of the cars.

there's some pics for your judgement. my concern is how will they fix the rear quaterpanel?? it's not like a seperate piece. its connected to like the top of the car and junk.... front.jpg has the best pic iirc

i read somewhere that it was illegal to have your insurance rate raise if the accident was not your fault

Its gonna be expensive. Sorry for your loss.

At least you know who hit you; I've come out of a parking lot to find my car mangled by some other car with no one to blame.
