Q about ebay transaction

I bought a battery pack on Ebay for a tool that was supposedly used, per description (though in title it said new); I assumed it was used. In the picture it looks as it should and description was that it seemed in good order and auction picture said "this is the item". When it came in the mail it was missing most of the screws on the pack (visible in the picture) and the internal cells were jiggling. Also, its resting voltage was so low that it had clearly been abused. I emailed the seller and he claims that he took the battery pack directly out of a tool kit, which is simply impossible. I am familiar with these battery packs and know that he or somebody tampered with it and did not put it back together properly.

He has claimed that it was new and will only, per his return policy, refund my paypal. That's fine, but this battery is over $100 and I want him to eat return shipping, too. The only recourse I have here is to leave a negative rating (he has 99%, btw, over 1000 orders, but 4 negatives in the last 250 for problems like this one) if he doesn't pay the $7.

So, should I send back and then if he doesn't give the $7 give a negative rating, or should I put in a complaint with Ebay now or with Paypal now? I am thinking to send back and ask again for the $7 and when I don't get it to just leave a negative, but I've never disputed anything on ebay OR paypal before.

You'll eat shipping both ways.

Paypal will be an easy win if you have to file a complaint though.

Ship back, get refund. Wait for him to leave feedback. Give a neg.

Just suck it up and get your refund and pay the shipping, and give him negative feedback

Leave the neg as soon as you get the refund. They can't neg you back. The "wait for him to leave feedback" is kinda pointless now

I believe sellers can still leave buyers neg feedback, they haven't implemented the planned changes yet.

That is why you wait for the seller to leave you feedback first.

If it's an item I simply don't want, yes. If it's an item that's clearly defective; inaccurate I believe the seller should eat the cost. That is simply good business and good manners. He remains incredulous at my description of the item but claims that when he receives it he'll match the serial numbers up to confirm that what he sent is what I received. Of course, I know it is. I estimate 80% chance I get my money back but if not I'll go to paypal.

I will leave a negative if he doesn't cover my shipping back. I don't care if he leaves one back to me. When are the planned changes kicking in, btw so that sellers cannot leave negs?

FYI, even if you go via paypal, you have to geat the return shipping, that just how it works.
