Might technically be his fault, but the law still will say it's the person backing out. So the OP would be liable for damages.

QFT. Old people here are always backing out and getting broadsided. I know of noone that technically hit these people that have been at fault (florida is no-fault though), however; the other insurance company has always paid it out.
 
So never ran into the guy again and according to all of you, it would have been seen as my fault, so I don't care anymore but...

I went out yesterday to fix it, my buddy and I were going to see what we could do. He walked to the back of the car and said, "did you knock it out already?" Went back there and was at a loss for words.

I'm assuming maybe the other day when it was hot out, the car sat in the sun while I was at work, so the plastic maybe expanded enough or something and popped out? Or some other trickery?! Toyota came around and fixed it for me for being a valuable customer?!?!!!?! ....MAGIC?!

Who knows, I don't care, its fixed! And I didn't have to do anything to it! 🙂
 
I feel for you, sometimes when i park and come back to my car, it's surrounded by these monster long suv's, can't see a damn thing.

A guy parked this suv/pickup truck next me, it had to have at least 8 wheels on it was wide and hard to see around, when i backed out of the spot, i slammed on my car horn so anyone approaching would take notice.
 
Oh hush you. He's talking about this specific instance in which the other driver was ignorant of the world around him.

I hope you are not being serious... If so you are in the same boat as exdeath...

If you are backing out and back out in front of someone and cause an accident it is your fault. It isn't regardless of the law. It is because of the law.
 
Driving on the blvd this morning in my convertible, top down it was beautiful today. This woman decided to pull out of her parking space as i'm approaching, so i changed lanes, to the left and passed her.
Now, were both stopped at a traffic light and she's in the far left turning lane, where separated by a wide cement Divider/Island, she started saying, thats not (cool) if she was a traffic cop she would take my licence away.
I said, PULLING OUT into on coming traffic isn't (COOL!)
It's not like she couldn't see me, WTF??? 😡

Hard to say here. A1A down here is a popular drive since it's along the ocean. Most drive way to fast though as if to prove something to the $XX million dollar homes situated along it. The smart people install mirrors on the road and post their own signs about the speed.

If she wasn't separated by that concrete island what would you do?

Sounds like you were in a residential area not a real 'blvd'.
