Pulled over and tested for drunk driving

Pulled over on the side of the road because my check engine light came on, and a cop immediately pulled up. After I was done looking under my hood, the cop asked me to step behind the car, asked if I had had anything to drink (which I replied no), and he did a drunk test on me anyway. Walk the line, follow the pen.

Was this a quota thing? I'm not pissed, because I'm sure cops catch random people like this all the time. But curious.

SHould have asked him why he believes you are drunk.

one cop told me it smelled like marijuana in my car, and then sniffered around, my coat in particular. he realized i was innocent of drugs/alcohol, seemed kinda disappointed about that and then wrote me a ticket for speeding.

In MN its actually a pretty common practice at night for police officers to accuse your car of smelling like pot. I've had that happen to friends before too, lol (non pot smokers mind you)

Ive been to India.. I am very surprised by this. The roads where I visit, Gujurat and Mumbai have NO LAWS whatsoever. And truck drivers and always one hand on the wheel, the other on the bottle. VERY unsafe. Maybe hyderaabad is different.

The thing is, I live in an area which connects via a major highway to the the IT parks out here. Also, I've heard rumors areas around Golconda Fort (close to my house) is sort of a major dumping ground for dead bodies and the like:p To top that off, drive just a few miles away from the junction and you officially leave Hyderabad City Limits and have miles and miles of open highway (with fewer police) which connects to these huge farms. In the middle of the night, I can assure you, with a half-decent bike with good tires, I can lose a whole squad of police cars in a chase. That is the reason why my area has increased security, I think. The junction I mentioned is one of the best (and safest) escape route for any criminals fleeing the city. There are a few other points in the city that are well-connected. And I'm fine with 2-minute stops every night, if it does indeed make the city a safer place.

Drop by in Hyderabad some time. We have the best track record in the country when it comes to communal tension, mindless violence and stuff like that. The govt. is doing a great job - and it's not even the government I voted for:p

Sounds like unreasonable search and seizure. If there is no outward indication that you're doing something illegal, there's not reason to assume you are. If he caught you swerving around the road, or stumbling around your car as you walked, OK. But not adding oil while pulled over.

Then again, this ATOT where many seem more than happy to have the SS trample your door down.

FYI, if you aren't drunk you should NEVER agree to a field test. Just ask for the breathalyzer and be done with it.

Bad idea. False positives happen, so unless you like spending a night in the pokey and facing a DUI for no reason, don't accept the breathalyzer until all other options are exhausted.

The OP didn't drink at all tonight.

This isn't preventative at all, it's just random and useless. Preventative would be stopping cars leaving a pub, or sobriety checkpoints in targeted problem areas. If I pull over, change a flat, check my oil, whatever, and give an officer no reason to believe I'm drunk, I don't want to be hassled with a completely random sobriety test.

And there is a reason we have a legal limit for responsible adults. In most states, it is .08 BAL. It exists because people don't want their laws dumbed down for the lowest common denominator. Having a beer or a glass of wine with dinner at a restaurant and driving home is perfectly okay.


The hell it is. there have been many times when one glass of wine gave me a serious buzz. if your buzzed you are under the influence period.

Well one glass doesn't get me buzzed, so I don't mind driving afterwards.

Sorry to hear you're a lightweight.

Not only that, but hell, how is having a very LIGHT buzz any different than driving to work half asleep early in the morning? Do you think someone who just had 3 hours of sleep and a shower is fit to be on the road?

You must agree to a breath or blood test. You do not have to do field side exercises.

You may have to take a ride with the officer though...they then are allowed and usually required to have you vehicle towed. You will pay special inflated DUI tow charges. They require cash to get your car back as well...they usually make it over $300 to prevent most people being able to get enough cash out that 'night'.

If you are innocent you still have to pay the tow fee and you will have to find your own way back to your car.
