Ok guys i dont know what to do on this one.

heres the lnk:click

The problem is i got the laptop and the battery doesnt hold a charge (doesnt even charge)
And i didnt get the software he mentionned in the ebay discription. (about what, 200$+)

i wrote him a few emails stating that the battery was DOA + the missing software.

I told him i was willing to meet halfway and forget about the software but i do want another battery.

He isnt willing to replace it, or take the laptop back...

Now i dont want to bring ebay into this but he isnt leaving me a choice now is he??

Any pointers on this one?

Actually trheaten his life first. Then threaten him by saying u will report him to Ebay and he will never sell there again. Then, report him to Ebay.

Well he edited his auction to say that the battery had "plenty of life left" and it clearly doesn't. I wouldn't say go as far as getting Paypal to simply refund your cash, since you did get the laptop and they might not do that anyways.

Let him know that he didn't follow through on his end of the auction on the two points (battery and software), and that all you want back is the price of a new battery (reasonable amount would probably be $100) otherwise you'll have to ship it back to him and get Paypal to refund your money, and he'll get negative feedback.

BTW Paypal will do partial payments:

You may issue a partial refund up to 60 days after receiving a payment. You must send the refund by using the Refund Payment link on the Transaction Details page for a particular transaction.
