Problem with ebay seller.. *UPDATE: THE THREAT WORKED!*

I purchased a digital camera (ricoh) for $192.00 via "BUY IT NOW." The auction was on August 6th and I paid immediately.. I needed the camera in a rush so I emailed the seller and asked when it would be shipped (explained that I had a trip, etc. etc. etc.).. She promised me that it would go out the next morning.. On the 13th I started getting a little anxious - I sent her a very nice email asking her for a tracking number. No reply... I emailed her on the 14th.. No reply.. I emailed her on the 16th.. No reply.. I finally request her user information to call her and leave a polite message saying that I expected the camera by now (especially since I paid $12 to ship it!) and that I would like either a tracking number or an explanation.. Of course, no reply... I waited 2 more days and then left her a message that was slightly less polite "Please email me or I will have to contact my credit card company to request a refund directly... " Anyways, I then receive this email:

hi sam sorry for delay with your camera...a huge crisis has occured the person that supplied me with had 54 of the ricoh rr30 cameras stolen out of the warehouse ...i have been attempting to find a different source at present ...if it soon don'[t happen i will refund your money so you can hopefully purchase else where....never had this to happen before what a nightmare...i am headed out of town in the morn on an electronic purchase trip and will get back in touch with you soon...sure sorry about this.....cindy

Needless to say, I'm pissed.. I paid for the auction on the 6th... She had 13 days to contact me and let me know this.. I would have happily accepted a refund and would have understood (even though it's unethical in my book to auction off something that you don't physically have).. I don't want a refund if she can't find a source, etc. etc. etc.. I want a refund NOW - what should I do? Threaten to call the B.B.B.? Call the credit card company (paid via paypal)? Notify ebay? I sent her an email asking for an immediate refund but I know that she doesn't read her email every day.. This is just so fvcking frustrating....

Any advice?

Her userid on ebay is crystalpistoltradingpost ... Her feedback is excellent but something like this shouldn't happen if you're a good business person...

UPDATE: My threatening phone call worked! I woke up to a paypal refund in my mailbox.. COol 😉

Is there a way to do this without the seller's consent? I don't think that she would fight a refund but she's obviously trying to buy time and is probably ignoring my emails.. (I sent her a payment request via paypal already).

assuming you used PayPal, i would get a refund.

PayPal will hold the money unless the seller can prove that they've shipped it out (via tracking number), IIRC.

Has nothing to do with the seller.

Thanks for the suggestion of going through Paypal buyer protection.. Seems like a relatively long process though (could take up to 30 days)... I think I'll wait 2 more days before starting the whole ordeal....

I just called her and left her a message.. The rudest message I've ever sent in my life.. I told her that I would notify ebay, paypal, my credit card company, her local police, and her local B.B.B. (item sold from a business) if I do not receive a paypal refund in 48 hours or less... I normally wouldn't be so anal but she told me that she was shipping the product the next day ("It's packed and ready to ship!") so I'm extra peeved...

Thats also giving her two more days to clear her paypal account of all its funds...

Well, I don't think that she'd do that.. Her rating is in the thousands rage and I'm positive that this was just a major screw up on her part and not totally fraud...
