A female friend of mine who has always maintained a pro-choice stance in any abortion debate told me the other day at lunch that she was voting for McCain-Palin. I?m not sure if her declaration was intended to solicit a reaction from me or not, but I was mindlessly self absorbed and didn?t give it much of an afterthought at the time.
Then I saw this, which is the complete text of what will become law if Measure 11 passes in South Dakota.
With Measure 11, the State of South Dakota would ban all abortions expect in cases where the mother?s life or health is at a substantial and irreversible risk, and in cases of reported rape and incest.
If Voter?s adopt the law, which is likely to pass, it is guaranteed to be challenged in the court system, and almost guaranteed to go before the Supreme Court.
In my opinion, with the courts current makeup, Justice Kennedy is the likely swing vote and is unlikely to change his position from Planned Parenthood vs Casey. Former Justices Blackburn and White were replaced by Justice Breyer and Justice Ginsburg, still leaving it a potential 5-4 vote. But, when you take into consideration that Justice Stevens is 88 and Ginsburg is 75 and that one of them retiring or otherwise leaving the bench could change the situation, it forces you to think about the potential for the next President to be picking a Supreme Court justice.
I asked her if this would change her vote, her response was an emphatic ?No?, with an indication that she believed Roe vs. Wade was a long shot to ever be overturned, claiming that there is no way the government could ever prevent a woman from having an abortion.
When I read this article today it got me wondering, are their more McCain supporters out there who label themselves as pro-choice and simply dismiss the possibility that a McCain presidency would potentially pursue Justices to presumably overturn Roe vs. Wade if an appointment to the court was needed?
