BERKLEY, Mich. -- The parking fine was $10. But the comment Robert Militzer added to the check could land him in jail for 30 days.

The computer programmer from Allen Park got the ticket May 29. When Militzer wrote the check to Berkley District Court, he scribbled on the memo line, "BULL (expletive) MONEY GRAB."

That got Militzer an in-person court appearance -- on a contempt of court charge.

He's scheduled to go before a judge Wednesday, accompanied by an American Civil Liberties Union attorney who will argue Militzer's remark is protected by the First Amendment.

Militzer, 38, was ticketed for parking in front of a friend's house overnight. He said he obeyed signs prohibiting parking between 2 a.m. and 6 a.m. during previous visits, but the signs weren't there the morning he was cited.

"I thought they were gaming me, collecting fines without giving people a fair chance to avoid it," Militzer told The Detroit News. "If the sign had been there, I knew what the law was. I would take my lumps and move on."

Militzer said he realized the off-color notation "didn't solve anything." But, he added, "It let them know I felt they were being unfair."

Richard Eshman, Berkley's public safety director, said Militzer could have requested a hearing to argue against the ticket.

"There's an avenue for protesting that kind of thing," he said. ACLU lawyer Elsa Shartsis said Militzer's "choice of words may not be the best, and it may offend some people, but it's not illegal."

That said, no I don't think this is fair at all, and probably should be thrown out, but it still gives me a chuckle.

Seriously - if the guy said that in court to the judge's face, I don't think anyone would disagree that it's contempt of court. This isn't too far from that.

That nicely worded letter would have ended up in the trash, now it's a news storywith the ACLU involved and I can laugh at how silly it is to waste time on something as trivial as this.

A good friend of mine wrote me a check for some stuff one time and I failed to read what he wrote in the notes section.

I remember the little teller girl snickering, and when I said "What?" she pointed out that it said "For: Oral sechs" at the bottom.

Luckily she knew my friend personally and knew he normally did this sorta stuff to people.

she was hot too.

That doesn't diminish the fact that he did speak his mind, however filthy it came out on paper. Nobody forced him to write that curse word, he did it willingly.

Missed the day in civics class where the first ammendment was discussed huh? 100% protected speech. He'll walk on this. (it doesn't fall under any of the exclusions to freedom of speech as far as I can tell since the courts have long held that foul language != obscenity)

I'm glad the police ticket those who illegally park, but only those who park in areas that obstruct views around intersections. The rest of the streets should be fairgame with zero meters. City government makes a lot more from tickets than they do parking fees. It's extremely obvious why they continue to annex lots for "paid" parking around here and none of the locals like it...it actually has a negative impact on business.

Yes, I believe in the constitutional right to use whatever swear words I want wherever I want in whatever form I want. I rememeber reading about that right in my civics class...

I'd like to say that's Detroilet for you, but, unfortunately, the first amendment is being increasingly stifled every day throughout the country.

Not only that, but parking tickets, and traffic tickets for that matter, are a bullsh!t money grab bordering on indirect taxation.

Yes, but yelling FIRE will put others in danger and cause panic. Writing a swear word does not.
