Possible HIPAA violation, not sure what to do. Update: problem solved

So I went back to grad school this September (I'm 33, and wanted to switch careers). Part of the process is sending in the school your health/immunization forms. The packet they give has a spot for SSN & DOB & Name at the top of each page. I fill it out, and fax it over, and then call over to their health services to make sure they got all the pages. I speak to someone that has it in hand, and they confirm it's all there. In late August I start getting emails that my immunizations are out of date. I call them up and state that I have sent in the forms and that everything is up to date. They tell me it must be a glitch in the system, and they can see that my record is fine. I register for classes, no problem.

It's time to register for the upcoming unit of classes, and I start getting emails about immunizations not being up to date. I figure it's the same thing again, so I email the same people. This time they're not budging. Why? They don't have the packet, and they have none of my medical records entered into their digital system. I am growing increasingly furious, as I keep asking what happened to the packet with all my info on it, but their reply is "you just need to send in your medical records"...completely dodging the issue. So they have absolutely no clue where a dozen and a half pages with all that info on it is at this point.

So this week my best friend's father dies, and I'm dealing with that. I'm heading out of town and don't have time to run the forms over again, or find a fax machine (they can't accept email). The compliance person for my school is nice enough to help me out; she has me email her the form, and then she can use the school's fax to send it to health services. Problem solved. I get confirmation from her yesterday afternoon that the fax went through, to the proper fax #, etc. This morning I get an email from health services saying they can't find the forms. Seriously.

Do I have any recourse here? No random credit cards show up on my credit report, I haven't had any suspicious charges, etc. that I'm aware of or anything like that. But I am REALLY not ok with the fact that A) There are about 15 pages of my medical records with ssn/dob/name on them floating around, or that possibly walked out their front door and B) They lost them again when it was sent a second time.

I'm assuming this is some sort of HIPAA violation or something...but I have no idea what to do. Also, I'm really not comfortable with these jokers having anything to do with my medical forms at this juncture.


Cliffs:

1) Send school health forms with medical information, SSN/DOB/Name on each page.
2) School confirms they have forms.
3) School health services loses forms, has no idea where they went
4) School admin sends them my forms again
5) School health services loses them again.
6) What do?

update: I wrote them an email stating I was really hoping that this isn't a second instance of my medical records being lost by their medical office. 15 minutes later the forms serendipitously 'reappeared'

I'd go over in person and find the individual or individuals that catch those documents off the fax machine. Once you find them face to face, go from there. Just be nice when you talk to them and don't talk down to them. Those offices have a lot of forms coming in. Chances are, they have some OLD process to file them and just aren't organized enough to get them entered or retrieve them in a timely manner.

The same things happen to me every year when insurance asks me to fax forms to them. I send forms and get numerous calls stating they never received them. It takes me escalating the calls to a manager and having them personally handle things sometimes. Sadly, they want everything in a computer, but fail at converting analog to digital.

What school is this? I'd just keep a close watch on your credit, CC charges, etc. for a while...

Might want to do a security freeze on your reports if you're really concerned or see some fraudulent activity. Varies by state on the unlock fees but since the SC DOR gave away 4M SSN and bank information it's worth it.

Not really. Dept A blames Dept B blames Dept C.....

I was thinking the same, but there's no one really to blame but health services. I faxed them the reports directly, I spoke to someone who confirmed he was looking at it in-hand. The woman from my school has the fax report showing it was delivered. They don't really have any recourse here.

Do you still need immunizations at the age of 33? I mean, what could you possibly be vaccinated for at this point?

This isn't a HIPAA issue. It's an incompetant employee issue.

The solution is to walk the papers over in hand and give them directly to whoever needs them. And get a receipt with a name on it.

Chances are they're just piled up somewhere in the office, or possibly have been shredded. It's not a HIPAA violation unless they lost them on a bus or something where other non-privileged people can get them.
