Most, if not all, people that are claiming police brutality don't understand this point, and probably never will.As for refusing to disperse, it is unlikely that you will get either if you simply leave or offer to be arrested. Attempting to resist or verbally insulting the officers will result in a forcible action. This type of resistance is not what is considered peaceful, and anyone engaging in such should not expect to be treated with respect.
Apparently these are the only two options? If I'm seated on the ground and not actively resisting I would hope that the cop has sufficient training to not require either. It would take me less than 30 seconds to subdue someone who was not offering any resistance via a blood choke. Minimal risk of permanent injury and it actually renders the person unconscious. Maybe police need to start taking grappling lessons.
