I'm sure most of you have seen this ad at your local ebgames. But I got cheated out of mine. According to them, they told me that if they run out of advance link cables on the release date, they are no longer obligated to supply it with the preorder. Their claim is that it is based on an availability of cables.

Now... based on the signs you have seen and this ad above, is it deceptive advertisement? (as in no disclaimer whatsoever?)

For anyone who's not familiar with deceptive advertisement.

Update: I did manage to get a hold of Nintendo and they are compensating me for the cable, but nonetheless, I think I should contact corporate to inform them that it looks illegal to me. But before I do that... I just wanted to make sure it IS illegal.

Was there anything that said "while supplies last"? Those 3 words make so much BS legal.

I looked over the sign once I left the store and it didn't say anything about 'while supplies last'. I'll go back and take some pictures just in case. But the only stipulations was that it has to be a pre-order and that it's one per customer.

Edit: And let's just pretend I was an online shopper. I don't see a reasonable method to see that restriction on the website.

Cancel your preorder that that store, and do it online, or go to another EB.

I can return it since it's still sealed. But since it's being released today for pickup, I don't see how I can get another pre-order offer.

I actually did call the online store about it and they said that the 'availability' rule is a rule for all branches whether or not it's clearly stated.

I'm practicing my consumer rights. Ever since coming to Berkeley I'm feeling the need to protest something. :)

My research is moving along. I have officially started from scratch 3 times after my advisor told me to change my simulator language 3 times to meet the 'newest standard'.
