any idea why, cant seem to get them in dma mode Gigabyte P965-DS3

It could be some queer incompatability, especially betwixt the optical drives. However, confirm their master/slave jumpers and cable positions are correct (master on end) and that the storage controller driver from the included CD is installed. If so, try uninstalling the storage controller from Device Manager and rebooting, confirming the correct name (Intel numbers &c.) and driver and re-checking the transfer mode for the channel(s) and whether it can be changed to DMA if not already.
