My friend got screwed when he didn't show up to court also during a credit collection case. He was admittedly guilty but didn't know squat about the law. The credit collection agency told him there was going to be a court date but that it was optional for him to go. So he just said ok.

Of course, being optional doesn't mean squat. The court gave the colleciton agency it's summary judgement and my friend in on the hook for $5000 for what was originally a $500 debt.

Pepsico's arguments in the filing to try and vacate the judgment seem very weak. It's basically saying "we're such a big company that one area doesn't know what the other is doing, and the documents never got sent to the right folks". Well guess what, that's not the plaintiff's problem. I'm thinking the statute of limitations claim might hold more water, but arguing statute of limitations after a judgment has been rendered is a tough sell. I'm curious where this will go. I would not be surprised to see the company pay some dough to the plaintiffs and their lawyers to go away.

Ridiculous. Pepsi won't pay, bottom line. The fine will be appealed and overturned by another judge.

What was this judge thinking? Pay day? Some company makes an error and she feels entitled to $1.26 billion dollars from their pocket? This woman is plainly out of her mind and should be removed.

How does 500 turn into 5000?

I think you're confused. The person files a claim, the defendant does not show up to court --> the plaintiff will get a default judgment. That part makes perfect sense. Now it's up to the defendant to go argue in court to try and get the verdict overturned, and that's not easy to do, even if you think it's a slam dunk.

I don't know about Wisconsin, but default judgments are frequently vacated. With that said, it's pretty lame to make the secretary take the blame. Could be her fault, but the attorneys are ultimately responsible.

Yeah, default judgments are often vacated, but it's not nearly as easy as it would have been had the defense actually showed up in court. Vacating something is much harder than just showing up and (probably) having the case thrown out. Contrary to what some in this thread apparently believe, this isn't some gross miscarriage of justice or something, this is regular court procedure and Pepsico screwed the pooch by not showing up. Now they have to undo that damage and get the judgment vacated.

the lawsuit is over the idea to sell bottled water. seriously, they think they gave pepsico that idea?
