To continue on with my string of drinking threads...
I'm just thinking...
I'm 20 years old. I am three months away from 21.
But, I'm wondering if I drink now and get caught what sort of 'punishment' would I face?
A ticket perhaps? Night in jail? Community service? I don't see how they could take away a driver's license if no vehicles are involved. Calling home to my parents certainly wouldn't do any good. Loss of government educational aid? Collegiate repercussions?

I'm not sure where to look on this. I've googled it but can't come up with anything definitive. Anyone know or know where to look?

PS: I'd like to avoid calling the cops to ask them.

Thanks.

I wouldn't worry about anything unless you plan on staggering down major streets with an open container in your hand. As long as you are drinking on private property and don't leave and drive anywhere there is little that the cops can do anyway.

Note that my last thread was regarding commuting on a bicycle while intoxicated. ;)
After much review and discussion, I decided that this was a bad idea.

But, if I'm just casually drinking at a party and the cops show up. Am I totally fubared?

the only way i can see you getting caught is through public intoxication. if you're dumb enough to walk down the street with a beer in hand you'll be spending the night in jail most likely.

I was busted for minor consumption. Here is what I had to go through. First, I had to attend court and face the judge. She spoke for 5-10 minutes then I had to meet with the assistant DA for my punishment. Being a first time offender and being cooperative during my arrest, I was able to sign a diversion agreement in which I had a few terms of probation to meet.

1. Must attend alcohol classes within 6 months (completed within 6 months)
2. Pay court fees ($100)
3. Probation for 1 year

The alcohol courses cost $250 so the experience cost me $350 plus I had to skip several classes to go to court and alcohol classes.

I was one of the few not to receive community service. Had I received community service I would have had to pay an additional $50-100 and would have gotten 40-80 hours of road crew.

Not sure about OK, but here in Texas, the cops can give you a MIP (minor in possesion). IIRC it's just a misdemeanor, and they charge you a fine...

Just remember: they have to catch you first! ;)

You can get MIP in oklahoma too...but seriously unless your party gets way out of hand....like 300+ HS students in a quail creek (neighborhood in Oklahoma city for you non oklahomans) the chanecs of the cops showing up is very rare.

In California, generally the police yell at you and tell you to go home, that's all.

I wish you well, but I think you are well on your way to more serious problems than punishment for public intoxication.
I traveled this road long brfore you were born, and I think that you really should reconsider your priorities.
I know that you won't, but I've said what I had to say.

Depends on teh state. In NC if I remember correct you lose your license, yes drivers, even if you were not driving. Plus all the Com. service and big fines. Also some colleges would put you on probation or kick you out, depends on college.

If in doubt just wait another 3 months, what are you a drunk already.

I got an MIP in Texas less than a month before my 21st birthday. I had two options.

1. Pay the fine (about $250 if I remember correctly) and lose my driver's license for 30 days.

2. Attend court. Plead No Contest and get the lecture from the judge. Pay court fees (about $150). Take Alcohol Awareness class ($25). Do 8 hours of community service and be placed on probation for 6 months.

I chose the second option, but if I didn't need a car for a month I would have done the first just to get it over with.

You CAN get a DUI (or should it be a BUI?) for bicycling while intoxicated. I witnessed a drunk biker getting pulled over & locked up for a 3rd time BUI offsense whlie they were writing up my tickets for speeding and not having headlights and a horn. (yes, I kept a photocopy of my speeding ticket which says "Make: Murray Model: Spectra" on it for humor value).

I wouldn't worry about a party getting busted like that. Never happens. Cops might show up, but they aren't about to write out tickets for everyone there. I guess it's possible, but I seriously doubt it would happen. Just be safe, drink when you aren't going to be leaving for the night, and you'll be fine. If you were to hitch a ride, you run a risk. So, for now drink only if you're sleeping there. That is on behalf of other drivers on the road.
