Paypal: Am I about to get screwed?

Hello all,

I sold this ebay item some weeks ago. The buyer finally paid last weekend. I shipped the item on Tuesday and he received it on Saturday.

He started a dispute today with the following wording:

The laptop arrived without battery and not operating. I do not accept the shipment and demmand inmediate reffund of the money. Now I understand why ebay eliminated this individual after my transacction. Please refund inmediately, or I have to proceede through mastercard agreement protection

Now I have no problems fully refunding money if the item was not working when he received it. However, I believe the item is fully functional and he is just bitter that it didn't come with a battery.

If push comes to shove and he proceeds with Mastercard or with Paypal - am I going to be out of luck?

PS - I shipped USPS priority with delivery confirmation and insurance.
PPS - My ebay ID has not been disabled.


[EDIT]It seems like no one agrees with me so that means I am clearly in the wrong. so the right thing to so is to refund him his money[/edit]

Unless I'm blind, nowhere in your listing did you mention the lack of battery. Did he ask you about it first?

he is just bitter that it didn't come with a battery.
I'd be bitter to if it was never mentioned.

Then yes, you're most likely screwed.

In addition, the fact that you didn't mention the absence of a battery isn't going to work in your favour either, as a laptop in "immaculate condition" has a reasonable expectation of coming with a battery. Maybe a stone-cold dead one, but a battery nonetheless.

Edit - I see I'm not alone on the battery thing. :p

This laptop is guaranteed not to be DOA

You should refund the buyer his money after you get the laptop back.

I can see that perspective and I am willing to discuss it with him. Ironically, I did not include a battery for a good reason - it didn't hold a charge and I don't like selling junk. I simp0ly recycled it :(

I can buy that it is almost assumed that one comes with a laptop, but he did assume this obviously and never asked me about it.

Yes, you didn't mention that is DID have a battery, but seriously....who buys a laptop without one?

Sort of a gray area on this one....I can see his point, but WTF is that crap about your Ebay ID being disabled?
Did he even complain to you first?

don't even try to argue it was his fault...even partially. you screwed up big time, and had I bought your laptop, I'd have had the same reaction.

If I recieved a laptop w/o a battery, I would've probably done the same.

A gaping hole where the battery is supposed to be =! immaculate condition

I can understand why he would be upset. However, refunding the money is too drastic (IMHO). As long as the laptop works, then if I get him a battery, he should be satisfied.

Mikey,

He is not buying a new product. He is buying used and I clearly listed what was included in the auction. He has to share some of the blame since he made assumptions and never asked any questions.

You realize that's like you bought a car without an engine, and you should just be happy if they get an engine to you in a few weeks.

Sad state of affairs if we have to ask if a portable electronic comes with it's battery. Especially from a seller with a near perfect record.

Momentary lapse. I do know better, but this was the 3rd guy in a row who bought the laptop and wanted it shipped to an unconfirmed address. I was getting very frustrated.
