It wasn't their speech about wanting to overthrow the govt (because they lost an election) that was a crime, it was when they actually tried to do it. But their free speech can be used as evidence.
I only mention this because many in the MAGA crowd seem to believe that they're being persecuted for their speech or their beliefs, when in fact it is for their actions.
