A Palestinian man has been convicted of rape after having consensual sex with an Israeli woman who believed he was Jewish because he introduced himself as "Daniel".

This is ridiculous for a variety of reasons. Maybe the "victim" should vet her sexual partners a little more if this is such a big deal to her.

Hopefully the Israeli judicial system will overturn this. 'Gideon Levy, a leading liberal commentator, said: "I would like to raise only one question with the judge. What if this guy had been a Jew who pretended to be a Muslim and had sex with a Muslim woman. Would he have been convicted of rape? The answer is: of course not."'

This case is just stupid. It was consensual. End of story. Judge should be removed.

While lying to get sex is awful, only in a country as bigoted as Israel could someone get sent to jail for this, and as one of my favorite Israeli journalists put it:

Gideon Levy, a liberal Israeli commentator, was quoted as saying: "I would like to raise only one question with the judge. What if this guy had been a Jew who pretended to be a Muslim and had sex with a Muslim woman?

"Would he have been convicted of rape? The answer is: of course not."

The court heard accusations that Mr Kashur misled the woman, whose identity has not been disclosed, by introducing himself with the traditionally Jewish name during a chance encounter on a street in central Jerusalem in 2008.
After striking up a conversation, the two went into a top-floor room of a nearby office-block and engaged in a sexual encounter, after which Mr Kashur left before the woman had a chance to get dressed. It was only later that she discovered Mr Kashur's true racial background, lawyers said.
Although conceding that the sex was consensual, district court judge Tzvi Segal concluded that the law had a duty to protect women from "smooth-tongued criminals who can deceive innocent victims at an unbearable price"
"If she hadn't thought the accused was a Jewish bachelor interested in a serious romantic relationship, she would not have co-operated," Mrs Segal said as she delivered her verdict
A woman meets a strange man in the street and has sex with him soon afterwards and wants us to believe this is how she looks for a serious romantic relationship?

This reminds me of a similar thing that used to happen, especially in the south in the USA,

that of a white female falsely claiming to have been raped by a black man in order to save face with daddy so she wouldn't appear to be the slut everyone else knew she was.

As to the OP: The defendant made certain claims AND promises (about their future). As silly as it may be, that is just like using a fake ID in the eyes of the law when treating the case. What made it worse was having sex under these conditions (used ID at the time - jewish, single, willing to continue the relationship blah blah blah, as opposed to him being muslim and MARRIED).
So it turned from "he lied to me" into "he had sex through lying and faking ID" which is a serious offense here.

As to the sentence, his lawyers are challenging the sentence and will most like drop the bargain so they can write off the rape charge completely.

Things aren't black and white...and you can't expect to get away with using fake ID to get laid. that's the law here anyway.

she was a willing participent and an adult. people lie to get sex all the time, it just so happens he wasn't jewish. If she wanted a lasting relationship, she shouldn't screw someone she just met on the street, no matter what he claimed to be.

If that is indeed the law, than it's a stupid law. As long as there has been sex, men having been ... *ahem* bending the truth *cough* to get it. "gasp, you mean you're not a doctor? I've been raped!" :rolleyes: And no, the comparison to fake ID is not valid. Fake ID would be actual fake documentation. If an underage kid goes to a bar and says "I'm 23!", and the bar fails to check his ID, the bar is going to get in trouble. If, however, the kid has a fake ID to 'document' his supposed age of 23, then the bar can say they did their due diligence and checked, the kid would get nailed.

Also, if it had been the other way around and the guy pretended to be a muslim, the outcome would have likely been very different. Seems pretty bigoted.

I'm not anti-Israel by any stretch, and rather I want to see Israel become a healthy functioning democracy for all its citizens, existing at peace with its neighbors. Granted, I can see how that comes off as trolling to bigoted warmongers like yourself.

No, this smacks more of how in the US, the most potent thing for a long time was black men wanting sex with white women - blacks were lynched for 'looking' at a white woman.

Why? Because whites could not bear the idea of 'their' white women being intimate with the black they had such bigotry for.

This smacks of that. While there's pretty much no history of 'but he lied and said he was white!' for obvious reasons, that would be the equivalent.

So this smacks of a sympathetic outrage on behalf of the woman out of bigotry against Palastenians - it moves from the normal sex fraud to crime because it's a dirty Palastenian.

That he is, and she is a scumbag for letting ethnicity play a role in who she chooses to sleep with. A match made in Hell, or I suppose "Gehenna" would be the more appropriate term to use here.

Who are you talking to? I want tolerance for everyone, and hence oppose discriminatory laws and practices, religion-based or otherwise.

I'm fairly certain they only do flogging for fornication, which of course is awful, but it's a good bit short of execution. Besides, while Saudi Arabia is near Israel, it doesn't quite neighbor Israel, let alone constitute "most of Israel's neighboring countries."
